Research On The Legal Response To Secondary Economic Sanctions Of The United States

In recent years,economic globalization has begun to show signs of ebb tide,and international sanctions have become an important external strategy and a new tool for some developed countries to normalize the new strategy of external strategy.The US government has also controlled the upgrading of the world economy and industrial value chain and sought an dominant position in international competition.On the essence of international competition,Chinese and American economic and trade are also experiencing a mutual economic and trade war between sanctions and anti-sanctions,containment and anti-containment.The secondary economic sanctions of the United States have expanded the scope of targets,exceeded the targets of a single trade target country,and extended to all individuals and entities that trade directly with economic activity in the target country.In particular,the United States also use the dollar in the core position of the global settlement system,through the sanctions target trading object from the international settlement system,such as secondary sanctions,forcing the third country individual or entity exit and sanctions target trading,make the economic unilateral sanctions gradually change and upgrade to another economy in fact the most effective economic transactions multilateral sanctions.The US government has continuously introduced secondary economic sanctions and expanded its external influence,which has attracted wide attention from the international community.China should also be prepared for risk assessment and response.China’s legal system to deal with economic sanctions and the blocking and countermeasures taken on this basis are gradually becoming institutionalized,systematic and refined,so as to actively respond to the new changes in the national security situation in the future,safeguard human rights and justice,and protect national interests.China’s legal system to deal with the US secondary sanctions still needs to be further supplemented and improved.This paper of some of the main trade countries in the secondary economic trade sanctions measures to analyze and judge,try to summarize relevant experience systematically at home and abroad,to make some suggestions for China sanctions response:international level response is more need us to widely reference and use the global multilateral trade cooperation development platform,also need more countries committed to promote the existing RMB globalization process.At the domestic level,it is necessary to improve the existing blocking law system,pay attention to the effective connection between relevant laws,coordinate the logic of the internal structure of laws,refine the relevant legal provisions,clarify the specific legal provisions,and enhance the implementation of the law.
