| The Party and The State pay more and more attention to the process of shareholding reform of rural collective assets,think it is one of the core contents of the reform of rural collective property right system,and hope to carry out it quickly and comprehensively on the basis of summarizing the experience of the pilot reform.However,there has been no specific legal provisions and policy guidance on the identification of membership and the allotment of shares by married women in the rural joint-stock system reform.This paper will focus on the membership identification of rural collective economic organizations and the allotment of shares by married women,further analyze the current situation of membership identification and the allotment of shares by married women,and put forward suggestions for improvement.The first chapter of this paper mainly introduces the judgment views and dispute focus of case samples.This paper introduces the specific circumstances of the case cited in the article and the judgment attitude of the court of first instance and the court of second instance towards the case,and leads to the two main issues discussed in the article,namely,the identification of the membership of married women in rural collective economic organizations and the equity distribution of married women in the stock conversion quantitative reform.The second chapter of this paper expounds the classification of married women,and then discusses the identification of the member root of married women in rural collective economic organizations through the laws and regulations,normative documents implemented by the state and different measures implemented according to the local situation in local provinces,cities and counties.Finally,combined with the selected cases of this paper,this chapter analyzes the content of this chapter and makes suggestions.The third chapter of this paper discusses the equity distribution of married women in the process of stock conversion and quantitative reform.Firstly,through the discussion of the laws,regulations and normative documents on the equity distribution of married women implemented by the state,as well as the different measures implemented by local provinces,cities and counties according to the local situation,this paper selects cases to analyze the content of this chapter,And make suggestions.By discussing the membership identification of rural collective economic organizations and the protection of the land rights and interests of married women,this paper puts forward innovative suggestions to protect the membership identification and the legitimate rights and interests of married women,so as to make a modest contribution to protecting the legitimate rights and interests of members of rural collective economic organizations and married women groups in China. |
