| With the rapid development of Internet technology,the trend of evidence information continues to expand,and electronic data plays an increasingly important role in judicial practice.But the electronic data is easy to damage,easy to lose,easy to tamper and other characteristics,resulting in its authenticity is questioned,affecting its effectiveness as evidence.Traditional witness technology relies on a storage medium,easy to cause the electronic data loss,modified and forgery,electronic evidence in lawsuits are of variable quality,in the process of evidence,the electronic data of the authenticity,legality,relevance,"nature characteristic" is difficult to guarantee,that is difficult,to play a decisive role in the facts of cases that cannot.Because of these defects,the proportion of electronic data admissible as evidence in court is still very low.However,the public credibility of the existing electronic data depository certificate platform remains to be verified,and the court’s acceptance rate is not high.Because of this,the traditional way of depositing credit card can no longer meet the existing demand.Block chain technology can protect electronic data,prevent tampering,and leave traces of data operation during the whole process of electronic data generation,collection,transmission and storage,thus providing an effective means for relevant institutions to review.Block chain technology is used for the preservation of electronic evidence.The electronic data that need to be deposited are recorded in the form of transaction,time stamped and recorded in the block,so as to complete the process of data preservation and deposit.Therefore,a platform for storing evidence based on block chain technology arises at the historic moment.The block chain has the characteristics of cross-region and decentralization,etc.Once the chain is connected,theoretically the data will be difficult to be modified.However,from the judicial point of view,as a new technology,block chain has not been explicitly stipulated by law.Therefore,this paper will discuss the evidence effectiveness of electronic data in the depository system based on block chain technology.Block chain depository system belongs to the category of electronic data security.In the first chapter,the basic concepts of electronic data security are summarized.By analyzing traditional security,the differences between block chain depository system and traditional security are compared,and the value and significance of block chain-based depository system are summarized.The second chapter introduces the status of the application of block chain depository technology,as well as the main technical principles involved in block chain depository technology,and briefly describes the three types of block chain.The third chapter discusses the validity of electronic data evidence in the block chain depository platform,mainly focusing on the authenticity,relevance and legality of the evidence.Among them,combined with the generation,collection,preservation and transmission of electronic data,the authenticity of the electronic data in the block chain deposit card is studied.By analyzing the correlation difference between the electronic data in the block chain and the traditional electronic data,the correlation of the electronic data is discussed.Analyze the relevant legal provisions of the existing block chain depository to explore the support of the block chain depository system for the legality of electronic data.The fourth chapter puts forward suggestions on the improvement of block chain depository technology from two aspects of legal supervision and technical regulation.In terms of legal supervision,the authenticity of electronic data can be improved by speeding up the construction of block chain legal and regulatory system,the combination of electronic evidence on the "chain" and evidence off the "chain",and the construction of regulatory system.In this paper,it is proposed to supervise the qualifications of the block chain depository and certificate platform,and more importantly,to standardize the block chain depository and certificate by inter-industry standards.In terms of technical regulation,smart contracts can be used to improve the privacy protection of block chain depositories,and time stamp technology can be used to ensure the authenticity of electronic data.It is proposed that not only the unilateral role of law and technology,but also the combination of law and technology should be used to govern block chain depositories in a two-pronged way. |
