| Minors are not only the jewels in the hands of the family,but also the hope of the society and the country.However,due to immaturity of minors in judgment,recognition and self-protection ability,so they are extremely vulnerable to the harm of criminals.Among them,sex crimes not only bring long-term physical and psychological problems to minors,seriously affect the healthy growth of minors,but also bring great challenges to the stability of the country and society,which is an important problem that we need to solve urgently.The problem of sexual abuse on minors has been regulated by various legal provisions in various countries.South Korea and China are both Asian countries,especially South Korea has established a relatively complete legal system to solve the sexual abuse on minors,so the study of South Korea’s laws on the protection of children and adolescents has certain reference significance for China.The experience of South Korea shows that blindly pursuing or punishing offenders cannot reduce the incidence of sexual assault on minors,and only by combining punitive legislation with preventive legislation can the phenomenon of sexual assault on minors be effectively prevented.Therefore,China should not only add special charges of sexual abuse against minors,appropriately raise the age of sexual consent,and clarify the severity of sentencing standards,but also establish a national identity information registration and inquiry system,reconstruct the professional prohibition system and other measures to prevent the recurrence of crimes.However,restrictions such as "electronic foot cuffs" and"chemical castration" do great harm to the rights and interests of sex offenders,so they are not suitable to be introduced directly in the initial period of China’s system when the actual effect is still in doubt. |
