Research On The Protection Of Children’s Online Privacy In China

China is in a period of rapid development of information network technology,the scale of netizens is growing rapidly,and at the same time,the proportion of younger groups is gradually expanding.The number of children surfing the Internet and the internet penetration rate is rising sharply,more and more children enter the open and interactive network world,and use Internet for online learning,communicating and entertaining.But compared with adults,children are immature and lack of self-protection consciousness,which makes online privacy violations against children occur frequently.It seriously affected the physical and mental health of children.Therefore,it is outstandingly important and urgent to conduct special protection of children’s online privacy.Currently,there are a lot of relevant regulations on the protection of children’s online privacy in terms of legislation and industry self-discipline,however,these scattered legal provisions have the characteristics of low legislative level and incomplete system and the Internet industry also does not have a perfect self-regulatory mechanism.As a result,the protection of children’s online privacy is still weak and various problems appeared,which is not consistent with the current situation of the rapid development of the Internet.Hence,based on this reality,this paper studies the issues of the protection of children’s online privacy in China,and makes a comparative investigation and reference to the representative models of foreign developed countries such as the European Union and the United States,in the hope of arousing people’s attention to the special protection of children’s online privacy and promoting the protection of children’s rights and the healthy development of Internet environment in China.This paper is divided into six parts,including the introduction,the four chapters of the text and the conclusion.Firstly,the introduction part gives an overview of the related concepts of children’s online privacy,and then elaborates the research status,research significance and research methods.Chapter 1 expounds the current situation of legislative regulation and internet industry self-discipline of the protection of children’s online privacy by combing the existing relevant laws and regulations and the norms of the Internet industry.And combined with the realistic background,it explains the main problems existing in the protection of children’s online privacy in China.Specific performance in the following aspects:the leakage of children’s online privacy is becoming more and more common,the degree of commercialization of children’s private information is increasing,there is no timely relief for the infringement of children’s online privacy,the development of new technology brings new hidden worries to children’s online privacy security.Next,Chapter 2 analyzes the reasons for the difficulties in protecting children’s online privacy in China,which is combined with the subject of responsibility for the protection of children’s rights and interests,mainly explained from four aspects,namely,the targeted legal protection system is not perfect,the Internet industry lacks a perfect self-discipline mechanism,the guardian’s guardianship responsibility is practically absent,and the long-term supervision mechanism has not yet been established.Chapter 3 is a comparative study of the representative protection modes of children’s online privacy outside the territory.It mainly introduces and analyzes the two world-leading protection modes:the legislative regulation mode of the European Union and the industry self-discipline mode of the United States.By comparing the strengths and weaknesses,it summarize the beneficial experience of establishing the protection mode of children’s online privacy in our country.Chapter 4 puts forward some corresponding suggestions according to the problems existing in the protection of children’s online privacy,which mainly includes improving the relevant legislation on the protection of children’s online privacy,implementing the parallel mode of legislative protection and industry self-discipline,improving and innovating the guardian’s consent system,as well as establishing a long-term network security supervision mechanism.The conclusion part summarizes the full text and expresses the expectation of establishing a perfect protection system of children’s online privacy in the future to provide children with a healthier and safer environment for online travel.
