| During the past 40-year reform and opening-up,China attained a great development and has jumped to the world’s second largest economy.Its comprehensive national strength,international status,and influence is keeping rising,more and more foreigners choose to travel and study in China,immigrate for working and settle as well.Implementation of "Belt and Road" and "Guangdong-Hong Kong-Macao Greater Bay Area" strategies given new opportunities for China’s economy.It’s common for foreigners starting work in economically developed areas in China.Their employment field is various from all levels,some of them are experts and high-end talents,who come for business startups,while others are engaged in labor-intensive or low-end service industries.Foreign laborers have brought domestic talent market new technologies and ideas,bring new energy as well,especially the high-end talents,who have made positive contributions to the development of economy and technology.Nevertheless,everything has two sides.Some foreign laborers in our country are legally employed while others are illegal.The illegal foreigner employment,which is also called“illegal labor” and “illegal employment” in the world,is a commonly problem in many countries.It ’ s hazard of lies in jeopardizing domestic social order and public safety,offending our borders and tax management systems,and disrupting labor market.China has promulgated series of laws and regulations to rectify the illegal foreigner employment,since the found in 1949.However,the problem has not been fully resolved,problems like inconsistent legal systems,lag and not applicable are still exist.In this paper,we analyze the laws,regulations and management systems on foreigner employment from the United States,the European Union,Japan,with the method of comparative research.Find out the parts worth using for reference,such as build a complete foreign labor regulations,set a unified management department,and strictly regulate the employment behavior of foreign laborers.To actively deal with illegal employment of foreigners in China,it is recommended to formulate and improve special laws for the employment of foreigners,establish institutions for unified management,prudently verified in immigration and visa management systems,conduct strictly investigation illegal employment of foreigners,encourage qualified foreigners to get legal employment,and strengthen community and public services for foreign employment management. |
