| School bullying is a student who is exposed to one or more student-led negative behaviors for a long time and repeatedly.Bullying not only has a long-term negative impact on students’ physical and mental health,but also has the potential to trigger adulthood crime.In statistics,the juvenile delinquency associated with school bullying actually shows an increasing trend.This research is based on the analysis of the social structure of campus bullying.Through the analysis of bullying-related data,it explores the academic,real-life trends and limitations of bullying.Through the analysis of campus bullying social relationships to explain the different impacts of such social relationships on campus bullying relationships,different levels or types of laws should be regulated.Furthermore,by comparing the social structure of the campus and the adult society,the current legal regulation methods,grasping the similarities and differences between the two,in order to find the loopholes in the current campus bullying legal regulation and propose legal paths and specific suggestions to make up for the different loopholes.This article is mainly divided into four parts.The first part first expounds the methodology of structural analysis in this article,expounds the definition of structuralism theory and structural analysis in the sociology of law based on structural analysis,and then briefly compares with non-structural analysis and applies structural analysis to practice Meaning in legal issues.In the definition of campus bullying,the campus bullying is defined on the basis of the qualitative nature of campus bullying by various official agencies and the academic agenda.Furthermore,it describes the development of the legal regulations on bullying in our country.The second part is a structural analysis of the social relationship of bullying on campus.The article focuses on the relationship between the bully and the bullied,and divides the social relationships that extend the relationship between neutrals,teachers and schools,parents,and administrative agencies into five types of social relationships that affect bullying on campus.Then,through its direct and indirect impact on campus bullying,and the degree to which it can be adjusted through legal regulations,the above five types of relationships are divided into three levels to illustrate their impact on campus bullying.The third part is to discuss and identify the loopholes in the current laws and regulations related to bullying on campus.The article is based on the social relations of the second part,and based on China’s current legal regulation system on campus bullying,it analyzes the targeted legal loopholes and points out the effective constraints under the confirmation of student responsibilities and the effective management under the system of non-segregation of teaching management.Legal loopholes such as problems,multiple powers and responsibilities that are lacking in parental guardianship responsibilities,administratively prone accountability-oriented policy factors,and insufficient regulatory restrictions on neutral groups.The fourth part proposes legislative opinions on the loopholes in the legal regulation of bullying on campus.Combining the influence of social relations and legal loopholes in the first two parts,it proposes legislative opinions that are relatively original and more in line with public resource conditions than the current legal regulations.The specific contents include "fines" for students’ personal property tort liability based on personality rights The establishment of an effective school bullying special institution,the differentiation of parental responsibilities to other subjects and the dual-track system of strengthening parental responsibility,standardizing the feedback channels of students and parents to government management agencies,and giving neutrals protection responsibilities. |
