Study On The Legal Issues Of Antarctic Marine Reserves

At the end of the last century,the whole sovereign countries began to compete for the highlighting level of the entitlements and benefits of the Antarctic Marine area,and constantly strengthened the research on the living and non-living resources in the Antarctic sea area,which broadened the vision of the development and utilization of the Antarctic Marine area.In recent years,there has been a new round of battles for maritime rights and interests,with the establishment and management of Antarctic Marine reserves as the main feature.Some countries have even put the development and protection of the Antarctic waters on the general task of their national strategies,concentrating all their efforts on the protection and development of the Antarctic waters.Based on the above international situation,this paper will start from the perspective of public international law and the law of the sea,analyze the research results of domestic and foreign scholars on Antarctic Marine reserves,and carry out a specific study on the construction of Antarctic Marine reserves.The first part chiefly presents the fundamental information of the Antarctic Marine Reserve,determines the concept of the Antarctic Marine Reserve through the concept of the Antarctic and Marine Reserve,and expounds the background of the establishment of the Antarctic Marine Reserve and its influence in the construction process.The second part analyzes the legal basis of the construction of the Antarctic Marine Reserves,mainly from the general international treaty provisions and legal treaties for the Antarctic region,which foreshadows some problems existing in the international legal regulations of the existing Antarctic Marine Reserves.The third part chiefly discusses the legal practice and subsisting problems in the construction of Antarctic Marine reserves.This paper mainly introduces two typical Antarctic Marine Reserves,and points out seven problems existing in the Antarctic Marine reserves.The fourth part responds to the questions raised in the third part,and puts forward the perfect path of how to better deal with the construction of Antarctic Marine reserves,such as setting up a comprehensive management bureau to manage Antarctic regional affairs in a unified way,and strengthening the binding force and supervision and implementation among member states.This is the innovation of this paper.The fifth part starts with China’s attitude towards the construction of the Antarctic Marine reserves and puts forward the strategies of China’s construction of the Antarctic Marine reserves.China should properly put forward a reasonable plan to incorporate the Antarctic management system into the global management model,reshape the concept of Antarctic human community with a shared future,and conclude a voting mechanism and compliance mechanism that give consideration to fairness and efficiency.This is also the innovation of this paper.This paper attempts to solve the problems existing in the construction of the Antarctic Marine Reserves,improve the relevant system construction of the Antarctic Marine Reserves,and put forward the strategies for China to deal with the Antarctic Marine Reserves.It is hoped that China can obtain the maximum benefits in the management practice of the Antarctic Marine Reserves.
