| Catastrophe is the highest level and most destructive disaster.China has a large land area and population,and is one of the countries with the largest number of catastrophes.The series of damage caused by the catastrophe has become a major obstacle to the realization of the two 100-year goals and the Chinese dream of the great rejuvenation of the Chinese nation.For a long time,China’s main solution to all kinds of catastrophe has been based on governmental aid and public welfare donations.The insurance in spreading risk and absorbing losses does not play a role in responding to catastrophes.The main reason is the lack of catastrophe insurance system.In order to alleviate the financial pressure of the state and effectively respond to catastrophes,China must establish catastrophe insurance system as soon as possible.Therefore,the study on china’s catastrophe insurance legislation has a strong practical significance.This paper mainly uses the historical and comparative research method to analyze China’s catastrophe insurance legislation.The first chapter is the introduction,which introduces the source,background and current research status of the subject at home and abroad.The second chapter discusses the definition,classification and characteristics of catastrophe and catastrophe insurance,analyzes the definition of catastrophe insurance legislation and summarizes the defects of current legislative situation of China’s catastrophe insurance.The third chapter draws the conclusion that the time is ripe for China’s catastrophe insurance legislation after analyzing the necessity and feasibility of China’s catastrophe insurance legislation.The fourth chapter summarizes the enlightenment of international experience to China’s catastrophe insurance legislation by comparing and analyzing the legislative situation of catastrophe insurance at home and abroad.The fifth chapter builds the basic framework of China’s disaster insurance legislation and discusses the design of specific legal systems,with a view to providing a realistic and feasible scheme for China’s catastrophe insurance legislation. |
