The rule of law is a symptom of a country’s civilization,and the degree of civilization of a country is usually judged by its attitude toward the elderly,minors,the disabled and other vulnerable groups.A good school environment is a guarantee for the healthy growth of minors,but the increasingly rampant school bullying has become a shadow under the sun,presenting the characteristics of universality,diversity of means,recurrence of implementation,and not necessarily poor students,and school bullying in China is more likely to occur among junior high school students,increase in behavior between females,and concealment of implementation.Looking at the global legal governance of school bullying,all of them have taken the development path of gradual regulation,comprehensive design,and integrated governance.China’s civil and criminal laws provide for civil and criminal liability for crimes and torts committed by minors according to the degree of harm,and the revision of the Law on the Protection of Minors and the Law on the Prevention of Juvenile Delinquency further clarifies the measures related to juvenile crimes and protection,which are intended to form a systematic regulation of school bullying.However,there are still many problems,such as the lack of special laws for the management of school bullying,the lack of prior prevention of graded prevention and clear intervention and prevention measures,the single subject of legal responsibility,the single form of responsibility and the difficulty in pursuing responsibility,the overemphasis on lighter punishment,and the neglect of repairing damaged relationships.A special Anti-School Bullying Law should be enacted to effectively assess criminal wrongdoing through a graded assessment scale in the prevention stage,establish a critical prevention system,and pay attention to the application of restorative justice concepts in the punishment stage to heal damaged social relationships and better realize the social function of the law. |
