Research On Copyright Law Protection Of Mash-up Video

With the rapid development of network technology,the popularity of the editing software allows many amateurs making mixed cut video and upload to share it with the use of fragmented time,the social interaction of joint and creators rich creative expression between mixed cut video has gradually become a new pattern of Internet information transmission,also promoted the mixed cut video industry vigorous development.In the real situation,without the permission of the author of the original work,the author USES his work as the mixed cut video as the creation material,which makes the infringement obvious with millions of playing and forwarding in the network environment.In order to avoid the occurrence of infringement disorder and promote the orderly development of cultural industry,it is particularly important to clarify the copyright protection of mixed cut video.On the basis of sorting out the production,classification and commercial operation of mixed cut video,this paper defines and analyzes the originality evaluation criteria,work attribute positioning,rights enjoyed and rights limitation of mixed cut video,and demonstrates the feasibility of drawing lessons from "implied license system" and "conversion use principle" in China.Based on the protection of mixed cut video under the current law,this paper analyzes the reasonable duty of care of different subjects involved in the mixed cut video,and defines the ambiguity of the current duty of care in order to protect the rights and interests of copyright owners.
