Study On The Fair Use Of Mash-up Video From The Perspective Of User Generated Content

Mash-up videos are a type of video that has flourished in recent years based on user-generated content.Unlike other videos,mash-up videos are the result of secondary production of copyrighted works.In the digital network environment,the public can easily copy and use copyrighted works,but there are very few copies and uses with permission from the right holder.Mash-up videos are just such a existence.Mash-up videos use copyrighted works a lot,but the rationality of their use has been repeatedly criticized.This has become a fatal dilemma accompanying its vigorous development,and has caused discussions in the field of copyright.The academic community has two very different attitudes to this,one is to resolutely curb,and the other is to encourage development under certain conditions.However,there is currently only one case in the judicial practice field in Taiwan,China,which is being prosecuted.This disconnect between academia and practice has made the future of mixed video uncertain.And in the theoretical field of our country,most of the research on Mash-up video is to put it under various prerequisites,as a small branch of a certain kind of research to make a superficial explanation,there is no systematic understanding.This article will focus on fair use in the field of user generation for the following reasons:1.Controversial Mash-up videos and most Mash-up videos are user-generated content;2.The natural infringement of Mash-up videos makes it only rely on the fair use system to obtain legal status;The system is more rigid and itself full of controversy.Therefore,by analyzing the literature and sorting out various data and materials,I hope to be able to clarify the concept of the "Mash-up video" and distinguish it from other common concepts studied in the legal field,explain the characteristics of the video Cut the plight of the fair use of the video,and finally combine its own characteristics and infringement dilemma to find a localized method of using the fair use system.
