Research On Copyright Restriction System Of Public Digital Library

Public digital library has advantages in the possession of information resources,the status of public welfare and the support of national information strategy in the digital construction,and becomes the leader of this digital tide by virtue of its advantages in the process of digital development.Due to the need to digitize works during the construction of public digital libraries,in most cases,the authors’ relevant rights are not infringed carelessly,and thus becomes the object of attack by copyright owners.On the one hand,public digital libraries need to operate and develop,on the other hand,they also need to deal with the squeeze of copyright rights,so we need the copyright restriction system to ease up and balance the interests of all parties.However,the existing copyright restriction system in the digital environment has been unable to meet the needs of public digital libraries.Under the background of "Copyright Law",the development of public digital library presents a difficult dilemma.In the third revision of the Copyright Law,the relevant provisions have been revised but there is no breakthrough change,which is not enough to solve the problem of infringement in the digital environment.Based on the above reasons,this paper aims to solve the problem of copyright restriction system in the operation of public digital library under the digital environment.In the digital environment,the in-applicability of copyright restriction system to the operation of public digital library is mainly reflected in two aspects: legislation and judicature.In terms of legislation,due to the lack of synchronization between the perfection of legislation and the development of digital technology,the existing copyright restriction system cannot give full play to its own advantages under the digital environment.In judicature,because of the lag of copyright restriction system,the copyright disputes of public digital library also appear continuously.In order to solve this problem,we should first clarify the relationship between copyright restriction system and public digital library,and find that they are interdependent,promoting and coordinating,which proves that the operation of public digital library needs the standard of copyright restriction system.But under digital environment existing copyright system lag,leading to the development of the public library had certain obstacles,so the last on how to improve the system of public digital library copyright restrictions are proposed,public digital library development objective is to provide effective legal protection,to avoid unnecessary risk of infringement.
