Research On Credit Repair Mechanism Of Dishonest Persons Subject To Enforcement

Credit management is an important means of modern social governance,and the joint punishment system for trust-breaking is the core link of the current social credit system construction.In recent years,China has continued to promote the system construction of joint punishment for trust-breaking,but the governance mode is still mainly at the level of "policy governance" rather than "rule of law governance".Under the goal of promoting the construction of a good social credit system,the credit repair system is an indispensable part under the background of the joint punishment system for trust-breaking.Combining with the practice of the joint punishment for trust-breaking,focusing on the construction of the credit repair system in the joint punishment mechanism for trust-breaking,understanding the deficiency of the current credit repair system and learning from foreign experience are the only way for the legalization of credit repair in China.Chapter Ⅰ of this paper,starts from the basic concept of credit repair of persons who are subject to enforcement for trust-breaking in China,and analyzes the main characteristics of credit repair mechanism of persons who are subject to enforcement for trust-breaking on the basis of clarifying the basic connotations of credit,trust and credit investigation.On this basis,explore the necessity of establishing a credit repair mechanism for persons who are subject to enforcement for trust-breaking.Chapter Ⅱ of this paper,analyzes the status quo and practice of credit repair system of persons who are subject to enforcement for trust-breaking in China,and focuses on sorting out relevant laws and regulations of local credit repair system in China,listing typical cases of credit repair of persons who are subject to enforcement for trust-breaking in China,and finding out the difficulties faced by credit repair of persons who are subject to enforcement for trust-breaking in China are lower level of legislation and lack of institutional norms.Chapter Ⅲ of this paper,according to analyse and research the credit repair mechanism of the developed countries like America and the same culture circle of east Asia represented by South Korea,it shows that their credit market trading and management to the healthy development of the basic way is based on the complete laws and regulations,with a third party credit repair agencies as the main body,and supplemented by the society and the relevant departments for supervision and management.Therefore,by drawing on the beneficial experience of credit repair from outside the region,suggestions can be put forward to improve the credit repair mechanism of persons who are subject to enforcement for trust-breaking in China.Chapter Ⅳ of this paper,mainly aimed at the present problems of faithless person who are subjected to execution credit repair system in our country,drawing lessons from the beneficial experience of the credit repair outside of our country,and combining the reality of our country,putting forward to perfect our promise of specific recommendations for the persons who are subjected to execution credit repair mechanism,the following main aspects are: one is to strengthen the credibility of legislation for the person who are subjected to execution credit repair system,improve its legislative status;Second,establish a unified standard of credit repair for persons who are subject to enforcement for trust-breaking,clarify the principle of credit repair,refine the conditions of credit repair and standardize the process of credit repair;Third,improve the guarantee measures for the credit repair mechanism of persons subject to enforcement for trust-breaking,specifically,encourage the development of credit repair institutions and industry associations,strengthen the publicity and education of integrity,and strengthen the construction of credit repair supervision system for persons who are subject to enforcement for trust-breaking.
