| The personal financial information is the core asset of banking industry.China’s legal standards for the protection of personal financial information have not been promulgated.At present,the state administration for market regulation has issued information security technology and personal information security specifications to protect personal information.PBOC has issued technical specifications for the protection of personal financial information,Both are industry standards.Based on the analysis of the judgment of administrative penalty,this paper puts forward the problems of personal financial information in the banking industry,such as excessive information collection,entrustment,risk of prevention and disclosure.Through the research on the technical norms of personal information security technology and personal financial information protection,it is concluded that the personal financial information protection law should focus on clarifying the information differentiation regulation and combining with the industry standard information collection rules to strengthen the examination obligation of the information entrusting party and establish the information security management organization.Only by the laws and regulations of government by law construction can’t implement bank of personal financial information protection work,our country should further clarify the responsibilities of regulatory authorities in law to strengthen coordination service function of the industry association and by normalized financial education promoted our country people’s personal financial information security awareness,can form the banking system of personal financial information protection specification. |
