Research On The Expression Of Civil Rights In NIMBY Governance

With the rapid development of China’s economy,continuous improvement of industrialization level and acceleration of urbanization process,the number of NIMBY facilities is increasing year by year.In addition,with the deepening of marketization,the acceleration of democracy and rule of law and the rapid development of network informatization,citizens’ awareness of rights is gradually awakening.In the NIMBY events,the phenomenon of civil rights expression has become increasingly prominent,which has become a new field of civil rights expression.At present,although domestic researches have conducted sufficient researches on the NIMBY problem,most of them focus on decision-making,site selection,participation,technology and other aspects,and the effect is not obvious in practical application,and the NIMBY problems is still arising.From the perspective of civil rights,this study deeply analyzed the expression of civil rights in the governance of NIMBY,analyzed its purpose,method,channel and result,and tried to explore the root cause of NIMBY problem.In this paper,the method of multi-case study and content analysis were mainly used,and a total of 34 valid cases were obtained after screening.The elements of civil rights expression in NIMBY governance cases were encoded by manual coding,and a total of 4 first-level categories,10 second-level categories and 45third-level categories were obtained.Through the analysis of the coding results and case contents,it is found that the civil rights expression in NIMBY governance has four problems:the channel of expression is not smooth,the conflict is easy to break out,the result of expression is short-sighted and the relief of right expression is backward.The main reasons are that the construction of channels and ideas for the expression of civil rights are unfulfillment,the starting point of the government is different from that of citizens,the expression of civil rights is affected by negative psychology,and the relevant legislative safeguard system is not perfect.The NIMBY problems can be solved from the following four aspects: improving the ability to rationalize the expression of citizens’ rights,strengthening the construction of the channels for the expression of citizens’ rights,standardizing the treatment methods of the government and improving the laws and regulations on the expression of citizens’ rights.From a new perspective,this study can not only solve the dilemma of NIMBY,but also broaden the research extension of civil rights expression,which has both theoretical and practical significance.
