In recent years,the development of internet information technology has promoted the rapid growth of new forms of employment,and flexible employment has gradually become the constant phenomenon of employment.The flexible employment under the new employment pattern plays a vital role in the development of the socialist market economy with Chinese characteristics.At the same time,due to the diverse forms of flexible employment under the new employment form,the occupational risks borne by flexible employees,especially the risk of industrial injuries,are correspondingly higher.The application of our country’s current industrial injury insurance is based on the existence of a labor relationship between the employees and the employers.However,under the new employment pattern,flexible employees are no longer constrained to fixed work patterns,and the labor relationship formed are not completely consistent with the identification standards of traditional labor relationship,which leads to the risk of flexible employees being marginalized by the mainstream industrial injury insurance system.Therefore,innovating the industrial injury insurance system,expanding the scope of insured persons of industrial injury insurance,and including flexible employees under the protection of the industrial injury insurance system to adapt to the development of new employment forms,has very important theoretical and practical significance.Based on this,this article will study the issue from the following four aspects:The first chapter is an overview of flexible employment under the new employment pattern.This chapter mainly defines the new employment pattern and flexible employment under the new employment pattern,and analyzes the characteristics of the times to distinguish them from traditional employment methods.At the same time,it describes the development status of flexible employees,and then explains the necessity of including flexible employees in the industrial injury insurance system.The second chapter is the industrial injury insurance dilemma of flexible employees under the new employment situation.Based on judicial practice and through detailed analysis of big data judicial cases,this chapter summarizes the difficulties faced by flexible employees in labor relations identification,low coverage rate of industrial injury insurance,and lengthy procedures for safeguarding industrial injury rights and interests,and analyzes the reasons.The third chapter is aware of a systematic experience of incorporating an industrial injury insurance for a flexible.By sorting out the practice of innovative industrial injury insurance system in Germany,the United Kingdom and Weifang,Taicang and Wujiang in China,this paper summarizes the enlightenment of industrial injury insurance system for flexible employees that can be widely promoted in our country.The fourth chapter is the institutional path choice for flexible employers into the industrial injury insurance.This chapter aims at the industrial injury insurance dilemma faced by flexible employees in our country,from appropriately blocking the connection between the current industrial injury insurance system and labor relations,expanding the scope of industrial injury insurance insured persons,improving industrial injury insurance premiums,industrial injury identification,industrial injury insurance benefits payment,and broadening maintenance industrial injury rights channels and other aspects put forward suggestions for system improvement.
