Study On The Operation Of The People’s Supervisor System

As an innovative judicial system with distinctive features in the new period,the people’s supervisor system is an important system design for procuratorial organs to consciously accept external supervision.In the course of eighteen years,based on various problems,the system has been constantly learning from each other and getting rid of shortcomings.It has played an irreplaceable role in the people’s participation in the judicial process,and has gained the trust of the people and the recognition of the central government while making considerable achievements.In August 2019,the Regulations on People’s Procuratorates Subject to the Supervision of People’s Supervisors in Handling Cases was issued,further demonstrating the procuratorial organs’ sincere attitude towards accepting external supervision.The system has also moved forward under the guidance of the regulations.However,in the context of the reform of the supervision system,the power of investigation of duty crimes has been transferred,and the people’s supervisor system has lost its original operating basis,which forces the further reform of the system.In addition,in the system due to a late start,development is not yet mature,in the process of the concrete practice,the lack of legal basis,the supervision scope extensive,unreasonable selection system,imperfect supervision procedure,the rights and interests safeguard involved in supervision does not reach the designated position,and many other problems,these problems makes it hard for the supervision work of relevance,become a stumbling block to the system forward.Therefore,based on the analysis of the current judicial background,we should further reflect on the reality of the system,and urge it to continue to optimize and improve,so that the people’s supervisor system can fully release its potential and realize its due value.This paper includes introduction,body and conclusion.Among them,the text includes the following four parts.The first part mainly introduces the development course,orientation,function and legal basis of the people’s supervisor system,and further clarifies its orientation and value through combing the development course of the people’s supervisor system.The second part,through the actual operation of the system,combs the main problems,including the lack of legal basis of the system,the extensive scope of supervision,the unreasonable selection system,the imperfect supervision procedures,the limited rights and interests of participation in supervision,etc;The third part is to study the rich experience and theoretical achievements accumulated in the past operation of similar systems in other countries.It is to learn from each other and analyze what can be used for reference in China.The fourth part,according to the current problems of the system to put forward specific improvement path,including improving legislation,limiting the scope of its supervision,reform of its selection system,improve its supervision procedures,strengthen the rights and interests of personnel protection and other specific measures.
