Research On Non-litigation Dispute Resolution Mechanism In Urban And Rural Fringe Areas Of Chinay

Since the 19 th National Congress,the construction of civilized city is an important direction of urban modernization.The urban-rural junction is the transition zone between the city and the countryside,and it is also an important area in the process of urbanization.In urban and rural areas,due to the gap between the floating population and the local residents,the difference between jobs and academic qualifications,unfair distribution and labor employment and other issues show diversity,so that different types of collectivization to confront the disputes increasingly,the difficulty of solving is also increasing.Therefore,we should explore the construction of non-litigation dispute resolution mechanism represented by people’s mediation in urban and rural areas,coordinate the relationship between litigation dispute and non-litigation dispute resolution mechanism,strengthen the multi-party linkage of local government,internal community and grass-roots courts in urban and rural areas,and construct non-litigation dispute resolution mechanism matching the existing social development of urban and rural areas in China.In the course of this study,this paper combines the problems of the comprehensive management of the floating population in the urban and rural areas,the compensation for land collection and demolition in the urban and rural areas,and the comprehensive management of the household registration in the urban and rural areas.Based on the advantages of non-confrontation of non-litigation dispute resolution in urban and rural areas,the flexible advantages of regional application procedures and the initiative of both sides to perform independently,this paper discusses the problems existing in the dispute resolution mechanism with people’s mediation as the core constructed in urban and rural areas.First,some regions pay less attention to non-litigation dispute resolution;second,the support system of non-litigation dispute resolution mechanism is not perfect;third,the legal and legal basis of non-litigation disputes in urban and rural areas is insufficient;fourth,The effectiveness of non-litigation dispute resolution mechanism is relatively insufficient.Combined with the relevant experience of non-litigation dispute resolution mechanism in the United States and Japan,this paper puts forward that the non-litigation dispute resolution mechanism(ADR)should pay attention to the coordination of the relationship between different urban and rural subjects.Fully consider the relationship between urban and rural areas and social operation model.On this basis,this paper puts forward some suggestions to improve the non-litigation dispute resolution mechanism of urban and rural areas in China.First,improve the system of non-litigation dispute mediation in urban and rural areas;second,improve the support system of non-litigation dispute resolution mechanism.Third,improve the working mechanism of non-litigation disputes in urban and rural areas;fourth,strengthen policy support and enhance social credibility.
