On The Improvement Of The Rural People’s Mediation System

Mediation has existed in ancient times.From the Western Zhou Dynasty to new China,it has accumulated rich practical experience.Compared with other dispute resolution mechanisms such as litigation,arbitration,administrative mediation,judicial mediation,arbitration,petition and so on,the people’s mediation system developed on this basis has the advantages of easy acceptance by the masses,high performance rate of mediation agreement,intensification of conflict and dispute prevention and social cost saving.However,in the context of deepening the reform in an all-round way in China,the rural social economy is constantly transforming.In the past,the object,content and social foundation of the rural people’s mediation system have changed,which makes the traditional people’s mediation system face new challenges.What are the shortcomings of the rural people’s mediation system,and what are the countermeasures? Through visiting Zijin County,where the work is located,and using literature review,case analysis and other research methods,the author analyzes the shortcomings and causes of Zijin County People’s mediation,and tries to put forward measures to improve the rural people’s mediation system in Guangdong Province,hoping to continue to play the role of the rural people’s mediation system in resolving conflicts and maintaining social stability.This paper takes the rural people’s mediation system of Zijin County as the research object,and makes an investigation and analysis from four aspects: the construction of people’s mediation organization,the situation of people’s mediation cases,the basic situation of people’s mediators,and the rules of people’s mediation procedures.It finds that the rural people’s mediation system of Zijin County exists in the administrative organization of rural people’s mediation,the work of village(residential)people’s mediators is weak,and they should deal with difficult problems The problem of insufficient capacity of complex disputes and excessive mediation of rural people.After research and analysis,this paper believes that there are four problems in Zijin County’s rural people’s mediation system,the main reason is that the transformation of people’s mediation organizations is not valued,people’s mediators pay low,village(residential)people’s mediators have low legal literacy,and the boundaries of various mediation mechanisms are fuzzy.In view of the shortcomings and reasons of the rural people’s mediation system in Zijin County,this paper puts forward the following suggestions: first,reconstruct the people’s mediation organization and change the current situation of the administrative management of the rural people’s mediation organization;second,improve the treatment of the people’s mediators and stimulate their enthusiasm for work by increasing case subsidies and the government’s purchase of people’s mediation services;third,create the people In order to deal with all kinds of new and complex disputes in the period of social transformation,we should mediate the elite team;fourthly,we should make clear the scope of accepting cases of people’s mediation,and avoid the excessive mediation of rural people,so as to become the administrative means of public management of grass-roots government.
