Research On The Legal Aid System For Juvenile Criminal Victims

The establishment of legal aid for juvenile criminal victims is an important manifestation of my country’s Criminal Procedure Law respecting human rights and protecting vulnerable groups.The principle of two-way protection is the primary principle of our country’s juvenile criminal policy.While the juvenile legal aid system has been continuously improved,the legislation and theoretical research on juvenile criminal victims’ legal aid has also appeared to increase the situation.However,compared with juvenile defendants,legal aid for juvenile criminal victims is more fragmented and fragmented in legislation,and has been marginalized and even "secondarily harmed" in judicial practice.All this shows that the imbalance in legal aid protection between juvenile criminal victims and juvenile defendants has further increased.Therefore,the construction of the legal aid system for juvenile criminal victims is worthy of our further study.This article first summarizes the concept and characteristics of legal aid for juvenile criminal victims,and explains the value of exploring and constructing the system.Secondly,by analyzing and comparing the relevant legislation and judicial practice of the foreign victim assistance system,it summarizes its legal aid fund raising mode,institutional management mode and legal aid provision mode.Combining with the combing of the history of legal aid in my country,it is found that the establishment of the juvenile criminal legal aid system in my country has some unreasonable problems such as narrow scope of application,strict economic review,and post-positioning of legal aid time.Finally,this article proposes to enhance the status of juvenile criminal victims from the legislative aspect,achieve full coverage of criminal legal aid including juvenile criminal victims,reduce or cancel the economic review of juvenile criminal victims,and expand the law in judicial practice.Assist the construction of the talent team,explore the possibility of interconnection with the on-duty lawyer system,and improve the construction of the legal aid system for juvenile criminal victims.
