| Consumers’ right to regret has only been initially established in China,and its content is not perfect enough.Especially for consumers’ right to regret under the online shopping mode,the legal system is not complete,and consumers’ right to regret cannot be guaranteed under the online shopping mode,which violates consumers’ rights and interests to some extent.Therefore,in the context of online shopping mode,this paper analyzes consumers’ right to regret,and puts forward some suggestions for improvement in view of the problems consumers face in fulfilling their right to regret.This paper is divided into the following six parts: In the introduction part,mainly elaborated the purpose and significance of the research topic,the research status at home and abroad were sorted out and analyzed in detail,explained the research methods of this paper,and summarized the innovation points of this paper.The first part elaborates the concept and source of consumers’ right to regret under the online shopping mode and the specific provisions of the legal fee holders’ right to regret system in China.The second part summarizes the research status of consumers’ right to regret under the model of online shopping,including the period during which consumers’ right to regret is exercised,the applicable provisions of exclusion rights,the provisions of social e-commerce legislation,and the corresponding legal responsibilities of consumers’ right to regret.The third part points out the problems existing in consumers’ exercise of the right to regret under the online shopping mode:the exercise period of consumers’ right to regret under the online shopping mode is unreasonable,the application of exclusion rights is not clear,the application of social e-commerce in the legislation has defects,infringement of consumers’ right to regret is difficult to investigate the legal responsibility.The fourth part elaborates the regulation of consumers’ right to regret under the overseas online shopping mode.Mainly selected three typical countries: the United States,France,Japan for discussion,with reference to overseas relevant experience.The fifth part puts forward targeted countermeasures,redefines the period during which consumers exercise their right of regret,improves the provisions for the exclusion of the right of regret,improves the applicable legislation of social e-commerce,and clearly investigates the legal responsibility for infringing consumers’ right of regret. |
