The Research On Consumer's Right To Regret

Consumer's right to regret can regulate sells behavior, protect the rights of consumers vulnerable groups, guide consumers to rational consumption, and build a fair and orderly market order, and to promote the prosperity and development of the market economy. Foreign consumer's right to regret has been relatively mature, however, in China, consumer protection in the event of mainly in advance, lack of relief, has yet to establish preventive real system of consumer's right to regret. This paper introduces from the following four parts:The first part: introduce cases and put forward compulsive consumption, analyse the necessity of remedies from the factors that influence consumer's compulsive consumption.The second part: the system of consumer's right to regret: response of a feasible consumer's compulsive institutional arrangements. After foreign countries solving the problem of compulsive consumption, the unconditional return method is built through legislation about consumer's right to regret. China still has no real sense of the system of consumer's right to regret, clear the meaning of this system can lay solid foundation for its implementation. Consumer's right to regret is different from the right to cancel a contract, the right to terminate a contract and the right of return of a unique system arrangement, i.e. consumer's right to regret is the new legal right to consumer without the intervention of courts and arbitration institutions in a specific consumption field.The third part: this part introduce the function and meaning of the establishment of consumer's right to regret in China from five aspects. Whether in the information consumers have or in economic strength, consumers can not confront operators, so give consumer the right to regret is necessary. Consumers get a chance to think calmly can improve the quality of products or services and create a quality, equality, integrity, transparent trading environment. Consumer's right to regret have great significance for protecting consumers and establishing operator's reputation and image and maintaining market benign operation.The fourth part: the system is presented to build the conception of our consumer's right to regret. First of all, this part introduce the applicable scope, applicable exception, exercise conditions and exercise way, lists the comprehensive demonstrates the right of foreign consumer's right to regret and relevant regulations. This part of the real objective analysis based on case, by comparison analysis and empirical research method, absorbing foreign legislation experience, combination of our local legislation practice, to inquiry consumer's right to regret. In Chinathe condition to establish the system of consumer's right to regret is mature, our country should add consumer's right to regret to relevant laws and regulations. Secondly, this part puts forward legislation framework systematically. Finally, this part suggested that we should protect the realization of the right from legislation, judicial and administrative aspects.
