Construction Of Police Dog Identification System In Criminal Cases

As a special means of criminal investigation,police dog technology is widely used,which belongs to the category of criminal science and technology.The frequent use of police dog technology provides technical support and important guarantee for the detection of criminal cases.However,the legal role of police dog technology has not been recognized and is rarely mentioned in the relevant provisions of the law.Law workers are lack of attention and research about the identification of police dogs,ignore the role of police dog identification,do not give it the due legal level,which restrict the police dog technology`s usages in the arrest of criminal fields,in obtaining evidences and other aspects.In this paper,bases on the actual combat situation of police dogs,combining with the existing technical theory of police dogs in China,and draw on the beneficial experience of foreign police dog identification system,it is proposed to construct the police dog identification system in criminal cases in China,strictly regulate the police dog identification procedures,and promote the police dog identification system to play a greater role and value in the field of criminal investigation.This paper constructs the identification system of police dogs in criminal cases from four parts:The first part elaborates the basic meaning of the police dog identification and the police dog identification system,classifies and summarizes the application types of the police dog technology,analyzes the characteristics of the police dog identification and the legal attributes of the police dog identification behavior,and provides a theoretical basis for the construction of the police dog identification system.The second part investigates the status quo of the application of police dog identification in China,studies the status quo of the category identification and the same identification in practice,and comprehensively analyzes the defects of the application of police dog identification in practice,to provide a solid foundation for the construction of the police dog identification system.The third part focuses on the necessity and feasibility of establishing the police dog identification system in criminal cases.Firstly,the necessity of establishing the police dog identification system is expounded from three aspects.Secondly,the feasibility of institutionalization of police dog identification is discussed from two aspects: theoretical basis and practical basis.At the same time,the advanced practices and beneficial experiences of foreign police dog identification system also provide a direction for the construction of the police dog identification system in China.The fourth part in the police dog identification principle,implementation of the main body,police dog identification procedures and results of four aspects of the construction of the scheme,the new police dog identification of the main range of the division;The process of police dog identification is constructed from two aspects: starting procedure and implementing procedure.Affirm the result of police dog identification,determine the response form of police dog and the legal effect,make the system more specific,more comprehensive,and more operable,ensure the smell evidence of police dog identification in line with the objectivity.At the same time,the establishment of police dog identification review procedures,to ensure that the police dog identification of the behavior and odor evidence can withstand the legal test.
