From The Perspective Of The New Provisions On Civil Evidence On The System Of Civil Appraisal

In recent years,with the continuous improvement of modern technology and economic level in our country,the field of professional knowledge involved in civil litigation has become more and more extensive.In litigation,judges and parties with professional knowledge need the assistance of experts with corresponding knowledge.Our country’s identification system After many years of evolution,although it has been relatively perfect,the appraiser,appraisal opinions and some appraisal procedures are still immature and need to be improved urgently.In the new "Civil Evidence Regulations",the changes in appraisal clauses account for nearly a quarter of the overall changes,of which 60% are new clauses.Such a large-scale revision of appraisal clauses means that the appraisal system is in civil litigation.Significant status in China.This article will take the revision of the new "Civil Evidence Regulations" as an opportunity to sort out the terms related to appraisal,and explore the appraisers,appraisal opinions and relevant appraisal procedures in my country,so as to improve the appraisal system in our country.Starting from the general situation of our country’s civil identification system,combing the development context of our country’s civil identification system,comparing the German appraisal system and the American expert witness system,starting from the legislative level to explore the development trend of our country’s civil appraisal system.And through the listing of the legislative background and clauses of the new "Civil Evidence Regulations",we can visually observe this revision,so as to provide help for the analysis of related systems in the future.It mainly analyzes the rights and obligations of the appraiser,the review and revocation of appraisal opinions,the initiation of appraisal procedures,and the provision of expert assistance to the person’s land,reflecting the current status of the relevant system in my country,which is of great significance for finding out the problems existing in the civil appraisal system.The new "Regulations on Civil Evidence" imposes additional obligations on the appraiser,but does not reasonably regulate its rights,and the expansion of the judge’s power in the appraisal procedure will correspondingly affect the exercise of the appraiser’s rights;on the other hand,there are also expert opinions Issues concerning the subject of appraisal withdrawal,incomplete assurance of authenticity of appraisal materials,and vague positioning of private appraisal opinions Through the analysis of this article,the author puts forward four suggestions for the future development of my country’s civil identification system,and hopes that my country will establish a more mature and more detailed civil identification system as soon as possible,and promote the development of scientific evidence in China.
