Research On Community Correction Of Juvenile Probation Offenders In China

With the development of society,the concept and system of penalty are changing in the direction of humanity,civilization and effectiveness.Juvenile community correction is in line with the trend of penalty reform,which effectively prevents and reduces juvenile delinquency,and has gradually become the way of penalty execution to deal with juvenile delinquency in various countries.The newly promulgated "community correction law" has a special chapter on juvenile community correction,which reflects the importance of juvenile community correction in China.As an important part of juvenile community correction,there are some problems in practice,such as the main body of correction is not professional enough,the corrective measures are not targeted.Under the background of the promulgation of the community correction law,how to do a good job in community correction of juvenile probation criminals and help them better return to society is the purpose of this paper.Therefore,based on the field research on the practice of community correction of juvenile probation offenders in some areas of our country,this paper analyzes the problems existing in community correction,and puts forward feasible improvement countermeasures combined with the actual situation,so as to promote the smooth development of community correction of juvenile probation offenders in our country.This paper is divided into five partsThe first part is the introduction.This part mainly expounds the research background and significance of community correction of juvenile probation offenders,and combs the research ideas,main contents and research methods of domestic and foreign literature.The second part is an overview of community correction of juvenile probation offenders in China.This part mainly defines the relevant concepts,on the basis of comparing the concepts of community correction at home and abroad,defines the concepts of community correction and juvenile probation community correction,and discusses the particularity of juvenile probation community correction,including the particularity of correction object and correction method.The third part is the current situation of community correction of juvenile probation offenders in China.This part includes legislative status,practical exploration and experience summary.On the basis of understanding the relevant legislation of community correction,this paper summarizes the successful experience of community correction of juvenile probation offenders in Beijing,Shanghai,Guangzhou,Hangzhou and other areas through field research.The fourth part is to analyze the problems existing in the community correction of juvenile probation offenders in China.This part from the relevant legislation,correction subject,supervision and management,personalized education correction four aspects of our country minor probation community correction problems are analyzed,and on this basis,put forward the perfect countermeasures.The fifth part is to improve the countermeasures.Based on the analysis of the problems existing in the community correction of juvenile probation offenders in China,this part puts forward some suggestions from the aspects of improving relevant legislation,establishing professional correction force,improving supervision mode and carrying out personalized education correction,so as to realize the specialization and specialization of community correction of juvenile probation offenders.
