Research On The Investigation Of "Soft Violence" Committed By Underworld Crimes

In recent years,the crimes of the underworld has shown a new trend,especially in terms of behavior characteristics,that is,the traditional "hard violence" has gradually turned to "soft violence".Underworld crimes have serious social harmfulness,with severe and widespread influence,and "soft violence" has increasingly become a regular method for criminal forces to commit crimes,creating new obstacles for investigative agencies to crack down on the underworld forces,and against soft-violent criminal forces.Criminal investigation and evidence collection has become a major difficulty in judicial practice.Research is conducted with the new behavioral characteristics of soft violence as the starting point to analyze the current problems and dilemmas faced by investigative agencies in combating such crimes from the concept,characteristics,and investigation status of soft violence crimes.The proposed investigative countermeasures are expected to be of benefit to the current stage of anti-criminal and investigation work.Starting from the definition of the concept of "soft violence",it analyzes the legal application of this behavior in organized crime,and comprehensively analyzes the behavior of soft violence in combination with judicial practice.It analyzes the unique characteristics of soft violence crimes that are different from the traditional criminal forces,including the combination of soft and hard,strong concealment,low crime costs,corporate operations,and multi-field penetration and development.It also conducts empirical research on soft violence crimes by criminal forces,and analyzes the investigation status and difficulties of such cases,including the existence of judicial identification deviations,a large number of crimes,soft violence psychological coercion and organizational characteristics difficult to prove,and the wide temporal and spatial span of criminal behavior,objectively reflect on the current deficiencies of investigative agencies in combating soft violent crimes.On this basis,continue to explore the investigation countermeasures and optimization mechanisms of soft violence type criminals.Firstly,deepen theoretical research and accurately apply the law.Strictly implement the criminal policy,and clarify the certification standards for the crimes of the soft-violent underworld forces,so as to correct the situation of uplifting or downgrading in practice.Secondly,strengthen intelligence early warning research and judgment,and strengthen investigation and filing.Broaden the sources of clues and reduce the number of crimes.Thirdly,focusing on the four characteristics of the crimes of the underworld,focus on investigation and evidence collection,especially the systematic evidence collection for the characteristics of soft violence,establish "soft and hard connections",objectively evaluate the harm results,and improve the evidence chain.Finally,improve the relevant guarantee mechanism.Use Internet+and big data thinking,strengthen multi-departmental collaboration,explore long-term mechanisms,and help normalize work of eradicating crime.
