A Study On The Soft Violence Crime Of Underworld And Evil Forces

With the continuous development of society,the means of crime also presents a trend of diversification.In this trend,soft violence has become the first choice for the evil forces to escape legal investigation.In the context of anti-corruption,China has increased the crackdown on the crimes committed by gangsters and evil forces.In recent years,judicial interpretations related to soft violence and underworld forces have been continuously introduced.The introduction of relevant criminal laws has also promoted the research of soft violence by Chinese criminal law scholars.The particularity of soft violence means is that it is different from the traditional violence.Its essence is to form psychological coercion or seriously affect the victims’ normal life and work through a series of means such as threat,harassment and gathering people to build momentum,so as to seek illegal purposes or form illegal influence.However,soft violence is not clearly defined in criminal law,which leads to different views on the nature of soft violence in practice.This paper tries to analyze the soft violence crime from different angles:The first part introduces the source of the topic,the purpose and significance of the research,compares the research status of domestic and foreign soft violence crime,analyzes the future development trend of soft violence crime,and briefly introduces the innovation points of the article and the main research methods in the writing process.The second part expounds the basic content of soft violence crime,including the nature of soft violence and the difference between soft violence and other means.In the nature,it shows the different views of scholars and puts forward their own opinions.In comparison with other means,it mainly analyzes the differences between soft violence and violence,harassment,threat,coercion and intimidation.The third part enumerates the four main forms of criminal activities of criminal syndicates and evil forces and summarizes their characteristics.In each form,it introduces in detail several main behaviors which are subdivided under this form in practice.Through the detailed introduction of several main forms of realization,it provides ideas for the identification of soft violence crime in practice.The characteristic part mainly analyzes this kind of crime from four aspects.The fourth part analyzes and studies the conviction and sentencing of soft violence crimes committed by evil forces in China.Through analyzing the soft violent crimes and evil forces’ soft violent crimes committed by underworld organizations,it enumerates the main accusations and the basis of sentencing application.The fifth part is the research on the cognizance of the soft violence crime of the evil forces in the judicial practice.This paper studies the identification of the soft violence crime of the underworld organization and the soft violence crime of the evil force.
