With the advent of the network era and the gradual maturity of information technology,the Internet has greatly facilitated people’s lives and also filled China’s economic market with fresh blood.Internet publicity has become the primary means of all kinds of people,but it also gives rise to a lot of malicious use of unfair competition means to seize business opportunities.Among them,the false publicity in the commodity display is the root cause of the false publicity on the Internet.Due to the hidden,convenient and fast characteristics of online false publicity,compared with the traditional false publicity,it has more destructive power in the market and more serious infringement on the legitimate rights and interests of consumers.Therefore,it is also urgent to supervise and regulate the behavior of false propaganda on network platform.In view of this practical problem,this paper USES case analysis method and literature analysis method,takes the false publicity case in the circle of friends as an example,and combines the newly revised anti-unfair competition law to analyze the definition,supervision and relief of false publicity on the Internet and explore the corresponding legal regulations.Through sorting out,we found that the focus problems mainly include: first,the definition of online false publicity behavior;second,the supervision of online false publicity behavior;third,the relief of online false publicity behavior.Since it is the premise and core to determine whether the behavior belongs to false propaganda,the concept and classification of false propaganda behavior on the Internet should be defined first,and the particularity and identification method of false propaganda behavior on the Internet should be explained compared with the traditional false propaganda behavior.Secondly,it puts forward the legal regulation status of online false propaganda behavior,and analyzes the existing defects in supervision and relief methods based on the full text.In terms of supervision,there are mainly three problems: unclear rights and responsibilities of law enforcement agencies,unfavorable supervision of online platforms,and imperfect market access mechanism of online platforms.On the problem of relief,through the analysis of the current relief methods,it concludes three defects: the difficulty in determining the network jurisdiction,the limitation of consumers’ right to know and the lack of administrative penalty.Finally,the paper puts forward some Suggestions to improve the supervision and remedy methods.In terms of supervision,we can improve the supervision system by clarifying the rights and responsibilities of law enforcement agencies,determining the legal responsibilities of online platforms and improving the market access system of online platforms.In terms of the remedy method,we can perfect the legal remedy method by perfecting the jurisdiction of network cases,perfecting the system of consumers’ right to know and increasing the intensity of administrative penalty.At the same time,this paper finally emphasizes that to better regulate the use of We Chat false publicity behavior in the existing problems also need to strengthen the industry self-discipline and law publicity work.
