| Universal jurisdiction refers to the power of a country to prosecute criminals who have committed international crimes,regardless of where the crime occurred or the nationality of the suspect,or other jurisdictional basis recognized by international law.In the past two decades,Africa has been the main area involved in the exercise of universal jurisdiction by Western European countries.Africa has attached great importance to the issue of "abuse" of universal jurisdiction,and has therefore promoted the United Nations General Assembly to change the scope of the principle of universal jurisdiction.The issue of "and its application" is included in the work agenda;and in order to combat related crimes in the African region,the African Union and African countries also attach great importance to the role of universal jurisdiction.Therefore,studying the practice of universal jurisdiction in Africa is of great significance.This article will mainly study the practice of universal jurisdiction in Africa from three different dimensions.The first dimension is to conduct research from the perspective of the Cairo-Arusha universal jurisdiction principle.There are many principles of universal jurisdiction in the world,and the Cairo-Arusha universal jurisdiction principle is based on the African perspective.It has typical African characteristics and reflects the focus of African countries.Research on this principle,It will contribute to the understanding of African positions and practices.This dimension is actually the premise and foundation of the latter two dimensions.The second and third dimensions will study its related practices from the perspective of the African Union and African countries.Through research,it is found that Africa has developed the Cairo-Arusha universal jurisdiction principle with its own practice,and its position on the practice of universal jurisdiction has changed significantly.This article believes that the main position of the Cairo-Arusha universal jurisdiction principle is based on Africa’s own concerns.After the formulation of the principles,the follow-up practice of universal jurisdiction in Africa has further developed.Its position and characteristics are: As the main area where universal jurisdiction is exercised,Africa believes that universal jurisdiction is suspected of “abuse”,and this has promoted the international community’s attention to the issue of universal jurisdiction;but in the later stage,as Africa attaches importance to universal jurisdiction,it is cracking down on related issues in Africa.With regard to the role and function of crime,Africa’s position on universal jurisdiction has undergone a major change,and its position has become more constructive and enlightening.The practice of universal jurisdiction in the African region and its transformation provide important inspiration for the African region,my country and the international community. |
