In the late Qing Dynasty and the early Republic of China,with the collapse of the feudal dynasty,Chinese history entered the modern period,and the modernization of China’s legal system began simultaneously.During this period,the study abroad education of law and politics started,and the overseas study boom gradually emerged.A large number of ambitious young people went to Europe,America and Japan,among which thousands of students studied law.Some of them went into politics and took an active part in the legal reform at that time.Some devote themselves to legal education;Some become judges and lawyers,leading the progress of judicial practice.Obviously,the modernization of Chinese legal system is closely related to the education of studying abroad in law and politics.They influence each other and promote each other,which is a dynamic whole.The study from the perspective of law and politics education is helpful to clearly depict the process of the modernization of China’s legal system,help us deepen the understanding of that history and draw lessons from it,so as to strengthen the construction of modern rule of law.This paper focuses on the relationship between the education of law and politics abroad and the modernization of the legal system from three aspects: the first is the origin of the education of law and politics abroad,the group characteristics of the students of law and politics abroad,etc.,focusing on the answer of where the education of law and politics abroad comes from,why and what kind of professional talents have been cultivated.Secondly,describing the contribution of law and politics education to the modernization of Chinese legal system,including the enlightenment of the concept of rule of law,the influence on the legislation of many legal departments such as criminal law,civil law and commercial law,as well as the influence on the construction of judicial system.Finally,focusing on the historical limitations of the legal and political education abroad in the late Qing Dynasty and the early Republic of China.From the opposite direction,the congenital deficiencies of the legal and political education abroad as well as the various defects of the legal and political students are elaborated,further explaining that its effect on the modernization of China’s legal system is not entirely positive,but also negative.Based on the above content,relevant conclusions are drawn,and its historical significance is deeply summarized,and how to take history as a mirror to strengthen the construction of the rule of law in the new era is expounded.
