Research On The Supervision And Restriction Mechanism Of NPC To Supervisory Committee

Since China started the reform of the supervisory system at the end of 2016,the amendment to the Constitution and the Supervision Law have been voted and passed at the First Session of the 13 th National People’s Congress,which marks the preliminary completion of the design of the upper-level system for the reform of the national supervisory system.The establishment of the Supervisory Commission is aimed at strengthening and realizing the full coverage of supervision over all public officials exercising public power,fully reflecting the requirement of comprehensively governing the country by law,and at the same time integrating discipline and law enforcement into one,so as to form a centralized,unified,authoritative and efficient anti-corruption system and effectively improve the efficiency of supervision.However,absolute power leads to absolute corruption,in order to prevent the abuse of power,we must use power to restrict power.Because of the particularity of the Commission of Supervision,in order to ensure the exercise of the power according to law,the Commission of Supervision must be supervised.According to the existing supervision system,the supervision by the People’s Congress is the most democratic and authoritative.For a long time,China has also formed a supervision system with the People’s Congress as the core.As the state institution that produces the Supervision Committee,the supervision by the People’s Congress is legal and reasonable.However,in the new era,how to improve the ability and level of the NPC to perform its duties and carry out effective supervision over the Supervision Commission requires us to conduct in-depth research on the supervision and restriction mechanism of the NPC over the Supervision Commission on the basis of the existing legal norms.As the reform of the supervisory system has just been completed,the research on the Commission of Supervision is still not in-depth.In terms of the supervision of the Commission of Supervision,the academic circle mainly studies the external supervision mechanism of the Commission from the macro perspective,while there is very little research on the supervision and restriction mechanism of the National People’s Congress on the Commission of Supervision at the micro level.Therefore,on the basis of collecting a large number of documents related to the supervision and supervision committee of the National People’s Congress and consulting relevant laws,the author puts forward a new topic of "Research on the Supervision and Control Mechanism of the National People’s Congress on the Supervisory Committee" by using literature research method and comparative research method.First of all to the National People’s Congress to supervise the supervision of the Commission for the overall overview.It elaborates successively the concept of the supervision of the National People’s Congress,the concept of the supervision of the National People’s Congress and the necessity of the supervision of the National People’s Congress.Secondly,it analyzes the present situation of the supervision and restriction system of the National People’s Congress to the Supervision Commission.Through consulting and analyzing the norms of the supervision system of the National People’s Congress to the Supervision Commission,and summarizing the main contents of the supervision system of the National People’s Congress to the Supervision Commission,four main problems of the system are concluded: The NPC’s lack of form in hearing and deliberating the work reports of the Supervision Commission,the single rigid supervision form,the incomplete and insufficient disclosure of the supervision procedures,and the insufficiently specific supervision procedures provide a basis and entry point for the improvement of the following systems.Next,it analyzes the external supervision of the ICAC in Hong Kong,hoping to provide reference for the research of the Supervision and Supervision Commission of the National People’s Congress through the analysis of the external supervision mechanism of the ICAC.Finally,starting from the problems summarized in the current situation of the system,it is expected to provide suggestions and suggestions for the improvement of the supervision and restriction mechanism of the National People’s Congress to the Supervision Commission through legislation to increase the supervision methods,standardize the supervision procedures and improve the specific legal provisions of the supervision procedures.
