Research On Criminal Policy In "Crime Crackdown"

Because of the increasingly characteristics of underworld forces and their activities for the past few years the degree of organization have become more extensive,wider area of persecution their behavioral methods have become more concealed,the erosion of grassroots government,and the increasingly rampant seeking "protection umbrella",January 2018,China decided to launch special fight activities.looking back in history of fight against underworld forces,relevant criminal policies have been characterized by severity,"crime crackdown" has developed the new idea of "hit early,hit the small,hit rightly" "comprehensive governance,source governance" and "combining with anti-corruption".these strategies have achieved good results in "crime crackdown" and have effectively hit and curbed the underworld forces.However,at present,there are still some problems that can’t be ignored in the criminal policy of "crime crackdown",such as imperfect legislative configuration,deviation of judicial determination,imperfect collaborative governance mechanism,and weak crime prevention function."Crime crackdown" as a special form of struggle has ended,but our country’s"crime crackdown" still has a long way to go.Further improving the criminal policy of "crime crackdown" and promoting the normalization of "crime crackdown" are of great significance to the prevention and combating of crimes committed by underworld forces.First of all,it is necessary to continuously improve the relevant legislative configuration of crimes committed by the underworld forces,refine the criteria for distinguishing crimes committed by the underworld forces,and consider incorporating crimes committed by the underworld forces into the criminal law as independent charges to better solve the problem of identifying crimes committed by the underworld forces in practice.Secondly,for improve the effect of implementation and further settlement the problem of deviations during execution,the judicial level needs to improve the substantive examination mode,In practice,improve the early intervention system of procuratorial organization,and forming a scientific and effective system to better regulate the judicial operation of the criminal policy of"crime crackdown" and ensure that is carried out on the track of the rule of law.At the same time,from the perspective of collaborative governance,the criminal policy of"crime crackdown" needs to further clarify the role orientation among multiple governance subjects and improve the convergence and communication mechanism of various departments.Finally,in view of the weak prevention function in the criminal policy system of "crime crackdown",it is necessary to continuously enhance the crime prevention function of the criminal policy of "crime crackdown"by strengthening the concept of prevention,improving the supervision and teaching policy of the criminals related to the underworld forces,reporting and reporting payment system,and strengthening publicity and education,and gradually build a scientific,comprehensive,three-dimensional and operational criminal policy system of "crime crackdown" in line with China’s national conditions.Only in this way can we squeeze the crime space of underworld forces to the maximum extent,and further promote the legalization and normalization of "crime crackdown" after the end of the special struggle activities.
