Research For Underworld Crime And Criminal Policy

As the most serious social harmfulness crime, underworld crime is always the crackdown and prevention key point for countries all over the world and international society. With our country's politics and economy transition, the underworld crime which has been deracinated for a time has revived, developed and extended quickly. Therefore, studying, discussing and establishing criminal policies which focuses on underworld crime punishing and prevention becomes the most pressing matter of the moment.The criminal policy for underworld crime is a new field for crimes criminal policy in our country. In China, the meaning of criminal gang in a broad sense includes underworld. So the crackdown on underworld crime is carried out as a part of the crackdown on the whole criminal gangs, which makes the criminal policy for the underworld crimes in our country lacks of technicality and system. In theory circles, there are several dissertations on studying and discussing countermeasures for underworld crime, and there are also many different opinions on it. This paper plans to start from underworld research, make a further analysis on reasons for the underworld crime formation, developing disciplinarians in our country. On the base of forecasting its developing trends, this author will bring forward his own suggestions for improving the criminal policy for underworld crime in our countries.Except the foreword part, this paper will divide into four chapters.The foreword part has introduced the meaning for underworld crime and the relating criminal policy research in brief. It has also introduced the three conceptionsof organization crimes, underworld crime and crime with underworld property, and has stated that the above mentioned three conceptions can be exchanged each other.Underworld and underworld crime have the different conceptions. To study underworld crimes must make a definition for underworld at first. Therefore, in the first chapter of this paper, the author makes an analysis on the characters of underworld, and also makes a further statement for this conception.In the second chapter of this paper, the author analyzes on the China underworld crime phenomenon, developing disciplinarians and developing trends. And he also makes a definition for the conceptions and category of underworld crime in China.In the third chapter, on the base of seeing about the criminal policy of underworld crime in the main countries and districts all over the world, the author analyzes the status in quo of the criminal policy of underworld crime in our country.In the fourth chapter, the author starts from the reason of China underworld crime formation, combines the analysis on China underworld crime phenomenon, developing disciplinarians and developing trends in above paragraphs. On the base of forecasting underworld crime in our country, the author brings forward his own suggestions for improving the criminal policy for underworld crime in our country from directing strategies, legislation, anti underworld organs, the establishment of intelligence alarm system, the victim protection and other aspects. The author also brings forward his primary tentative plans for the internationalization of the criminal policy for underworld crime.
