| The principle of trust protection is a basic principle in many countries,which focuses on protecting the trust interests of the administrative counterpart.While exercising administrative power and paying attention to efficiency,the administrative subject should also safeguard citizens’ legitimate rights and social public interests.The principle of trust protection is the product of the development of democracy and the rule of law.It has changed the previous idea of government standard and paid more attention to justice,equality and human rights.Through the introduction of the application of the principle of trust protection in administrative act,this paper analyzes the development status of the principle of trust protection in China and the difficulties encountered in the application of administrative act,and puts forward some countermeasures to get rid of the difficulties,so as to improve the principle of trust protection in the application of administrative act in China.This paper is mainly divided into five parts,the first part is the introduction,which summarizes the development status of the principle of trust protection in various countries and the significance of developing the principle of trust protection;the second part summarizes the meaning,applicable conditions and theoretical basis of the principle of trust protection.The connotation of the principle of trust protection is that once the administrative act is made,it can not be changed at will.If it has to be changed for special reasons,it should give reasonable administrative compensation to the administrative counterpart.The applicable conditions of trust protection principle mainly include trust basis,trust behavior,legitimate trust and public interest.There are three theoretical bases of the principle of trust protection: the principle of good faith,the principle of legal stability and the principle of right standard;the third part mainly reveals the expanding scope and rationality of the application of the principle of trust protection in administrative acts through cases;the fourth part introduces the development dilemma of the principle of trust protection in China’s administrative application,mainly from the perspective of legislation and practice The fifth part is to put forward my own suggestions in view of the above difficulties,and strive to improve the application of the principle of trust protection in China’s administrative acts. |
