With the rapid development of Internet technology and the comprehensive popularization of smart phones,the term network virtual property appears in people’s vision.Has been limited to the original game account,game equipment and other aspects of the game only to rise to many areas.In real life,almost everyone has at least one smart phone,which makes us more or less connected with virtual property.Network virtual property is infringed,and there are many cases that bring disputes to court.However,there is a lack of relevant judgment basis,which makes the judge can only judge according to the traditional sense of property damage.But this obviously can’t make the case get a fair judgment.Network virtual property exists in the Internet server with its own unique attributes.The definition of property loss should be different from the evaluation mechanism of common property.Therefore,based on the professional knowledge of law and computer,combined with the understanding of network virtual property,this paper studies the loss and protection of network virtual property from combing relevant laws and regulations and literature to the case analysis in life,analyzes the problems and reasons existing in China’s network virtual property,and puts forward corresponding improvement suggestions.There are six parts in this study:Chapter one,introduction.This paper introduces the current situation of network virtual property in social life,and clarifies the significance of this study.This paper summarizes some research results on the definition and protection of network virtual property loss at home and abroad,and introduces the research content and research methods.The second chapter is the definition of the concept and legal attribute of virtual property.This chapter introduces some basic concepts and theoretical basis.Including the definition of network virtual property and the classification of network virtual property.This paper discusses the legal attribute of the network virtual property and gives the definition of the legal attribute of the network virtual property.The third chapter,the legislation status and typical case analysis of network virtual property.This paper analyzes the current situation of the legislation of the network virtual property in China,and analyzes the guiding cases involving the network virtual property in the current judicial practice in China,and summarizes the problems in the protection of the network virtual property.The fourth chapter,the problems of network virtual property protection.This chapter mainly analyzes the legal protection problems faced by the network virtual property in our country.In the previous chapter,through the analysis of typical cases in judicial practice,the main reason for the problems of virtual property protection is that the legislative protection is not perfect,which is embodied in the problems of evidence collection and proof,value and loss identification in practice.The fifth chapter,the Countermeasures of the legal protection of the network virtual property.Starting from the relevant legislative issues,this paper puts forward countermeasures for the problems in the protection of network virtual property summarized above,and puts forward constructive suggestions for the protection system of network virtual property in China.Chapter six,conclusion.This chapter is the conclusion part of the whole paper.It summarizes the analysis process of this study and emphasizes the content of the conclusion of this study.With the rapid development of Internet technology,China’s laws can not adjust the relevant content in time.Through the research of this paper,we can contribute to the theory and practice of network virtual property protection.
