A Study On Administrative Discretion By Customs Inspection Officers

Customs travel inspection is the abbreviation of the inspection of luggage and articles carried out by the Customs for inbound and outbound passengers.It is one of the business types of the customs.Compared with other customs departments,the tourism inspection department has the characteristics of strong instantaneity,high randomness of objects and high degree of social concern.As the front-line supervision work of customs inspection directly contacts with the vast number of inbound and outbound passengers and has a close relationship with them,the work of customs inspection has generally received extensive attention.At present,some passengers do not fully understand the relevant laws and regulations,and they have a one-sided understanding of the customs work,which makes the use of the discretion of the customs work widely concerned by the society.Based on the discussion about the discretion at home and abroad,combined with the author’s research and work experience in the front line of customs,this paper starts with how to better use the discretion to guide the work of front-line customs officers,looking for a better way to effectively use the discretion in the front line of travel inspection,so as to make the use of the discretion really land in the grass-roots front line.Based on the analysis of the relevant theories of administrative discretion at home and abroad,this paper combs the relevant theories of the discretion of the Customs at the scene of travel inspection,and compares and analyzes the characteristics and attributes of the grassroots front-line travel inspectors in line with the street bureaucrats.In this paper,the sample“ When analyzing the scene of "J" customs inspection,the paper focuses on the field investigation of the application and operation of discretion in the scene of grassroots inspection,expounds the current situation of abuse of discretion in detail,and points out that the grassroots customs in the use and management of discretion,including that the laws and policies are not updated in time,and there are obstacles in the implementation of law enforcement However,the standards of law enforcement are not uniform and there are some risks in law enforcement.Then it comes to the conclusion that the renewal of the existing customs system and regulations can not keep up with the current social development,the internal management is short board,the restriction is not in place,the problem of law enforcement unification has not been realized,and the great pressure of law enforcement and other related reasons.Finally,from the perspective of improving rules and regulations,strengthening internal control and management,this paper puts forward countermeasures and suggestions from the construction of law enforcement unity,strengthening team management,strengthening legal publicity,implementing law enforcement supervision and so on.
