| Since the emergence of international law," humanitarian intervention " has been a very controversial issue in the international legal community.After humanity entered the twentieth century,the war of armed intervention against other countries in the name of humanitarian aid also occurred frequently,which seriously threatened world peace and security.What war brings to mankind is not only the loss of life and property,but also the devastating threat to the survival and development of mankind once it spreads.Thus,the maintenance of world peace and security is not only the responsibility of the United Nations but also of all of us,and the tragic costs of the world after World War II have alerted all of us,if not on human grounds class of overall interests,war should be prohibited.In international practice,humanitarian intervention involves unilateral intervention by a State,a State or an international organization in the name of a humanitarian crisis or the threat of force against another State without a legitimate mandate,as well as the use of force or deterrence against a State that is a serious threat to international peace and security under the authority of the United Nations,while,on the basis of humanitarian relief,providing all kinds of assistance and relief to the State in question and helping the State in question to resolve the humanitarian crisis.From the point of view of international law,sovereignty and human rights are important theoretical and practical issues that can not be avoided in international politics and international law,while the essence of humanitarian intervention is the conflict between sovereignty and human rights.The point of debate is whether such interference should be allowed by international law on the basis of the protection of the fundamental human rights of a people and the use of force against that country at the expense of its sovereignty.To discuss the legitimacy of humanitarian intervention,it is necessary to explore the protection of human rights under the purposes of the United Nations based on an analysis of the relationship between human rights and sovereignty,and to find the basis for interference from existing international law in order to explain whether humanitarian intervention under the framework of existing international law meets the basic requirements of international law and whether it is necessary to legitimize humanitarian intervention.From the current international practice,the so-called humanitarian intervention,with the exception of the United Nations-mandatedmilitary intervention for the purpose of achieving international peace and security,the essence of most military intervention in the name of humanitarianism is not based on the protection of the human rights of the peoples of the countries in question,but only on the protection of human rights.Only to achieve the unilateral political objectives of the intervening State.On the one hand,such unilateral interference by force has no basis in international law,on the other hand,if such interference by force,in the name of humanitarian intervention,is legitimized by the interventionist State in pursuit of its political self-interest,it will surely lead to a new humanitarian catastrophe and will not be conducive to the maintenance of world peace and security.The intervention by force under the authority of the United Nations,mainly based on the maintenance of world peace and security,which is consistent with the purposes of the United Nations and the common interests of all mankind,should be carried out in order to eliminate the spread of war and achieve peace in the intervening countries while achieving humanitarian assistance to the peoples of the intervening countries Hold on.On the issue of humanitarian intervention,my country has always adhered to the basic principles of international law on non-interference in internal affairs,while also fully concerned about the human rights protection needs of the people of the countries concerned,based on the common needs of sovereign independence and human rights protection,supporting armed intervention for the purpose of peace and security under the authority of the United Nations,and opposing unilateral intervention in the name of humanitarianism by States or groups of States aimed at realizing the demands of the intervention States themselves.With regard to humanitarian crises in some countries,my country has always advocated the promotion of full cooperation among States through peaceful means. |
