Consideration And Improvement Of Problems In Auxiliary Police System

With the steady advance of public security reform,the auxiliary police system has gradually entered people’s vision and become a hot topic in the new round of innovation of public security management system.Compared with the auxiliary police in foreign countries,the auxiliary police in China has been limited to the position of expedient assistance personnel,lack of a special law or departmental regulations,by the local grass-roots governments to formulate regional auxiliary police management regulations or management opinions,which is also the cause of many auxiliary police system problems.Therefore,some scholars have questioned the necessity of auxiliary police officers.On the premise of having enough police staff,there is no need for auxiliary police,which not only facilitates the internal personnel management of public security organs,but also fundamentally solves the illegal law enforcement phenomenon of auxiliary police in news reports.However,since the era of planned economy,China has had the early obligation of the fire brigade,the public security committee,the public security joint defense team and other autonomous self-defense organizations,in a certain historical period have played a considerable role in maintaining public security.Nowadays,under the unitary state structure,local governments can stimulate and maintain the enthusiasm and initiative of various grass-roots units under the premise of following the unified leadership of the central government.The centralization of police power certainly follows this constitutional logic,and local public security organs are restricted by local governments and superior organs in staffing,financial funds and task arrangement.Due to the rapid development of the society,the demand for public security is gradually increasing.The grass-roots public security organs are restricted by the division of the central and local functions and powers of personnel establishment and have no right to organize the expansion of police force.Moreover,China is in the stage of the transformation of police functions,from simple security maintenance to social services,the traditional police structure has been unable to cope with this situation,these are the objective necessity of the existence of auxiliary police.The current "regulations on the organization and management of public security organs" also clearly stipulates that professional skills or auxiliary positions can be employed,which provides a legal basis for the existence of auxiliary police.At present,China’s auxiliary police system is faced with such problems as legal positioning defects,unclear responsibility and authority,imperfect personnel management mechanism and frequent turnover of personnel.In order to solve these problems,it is necessary to solve the legal orientation of auxiliary police from the root,and revise it as the object of administrative entrustment,so as to provide theoretical basis for solving the contradiction of the current auxiliary police accountability mechanism and the system problem of lack of authorization basis.By referring to the overseas advanced management experience,the ministry of public security shall formulate departmental rules and regulations,adopt the legislative structure of local flexible legislation,and uniformly stipulate the recruitment and selection mechanism,training and assessment,personnel management,responsibilities and authority of auxiliary police.In view of the possible cross-functional parts,formulate or modify the supporting legal norms to make them more implementable.The division of the auxiliary police’s functions and powers is divided into vertical and horizontal dimensions according to the innovative thinking of the allocation of state power.On the horizontal level,according to the work content,it is divided into the civil auxiliary police and the service auxiliary police’s functions and powers.At the same time,we should also improve the supervision and accountability mechanism of auxiliary police,which not only needs the internal supervision of public security organizations,but also needs to broaden the channels of social supervision,widely analyze and adopt the opinions of the masses,and build a law-based auxiliary police system with consistent rights and responsibilities.
