Study On Legislative Improvement Of Crim In The Field Of Food Safety

Food is the most important thing for the people.Food safety is related to the health and quality of life of the public.In recent years,the crime in the field of food safety in China is increasing rapidly,not only seriously damage the lives and health of the public,and greatly influenced the social and economic development.So it is an urgent task to study the crime in the field of food safety and its legislation.This study takes the concept and current situation of food safety crime as the entry point,and through the analysis of relevant judgments published online in judgment documents,it understands the legal provisions and application status of food safety crime in China,and analyzes the existing problems in these legal provisions.In addition,some foreign laws and regulations related to food safety crimes are investigated to analyze their merits and demerits as well as places suitable for China’s legislative study.Finally,in view of the existing problems in China’s legislation,the paper puts forward Suggestions to improve the criminal legislation in the field of food safety.This paper consists of four parts:The first part defines the concept of food,discusses the scope of "food" in China’s criminal law,and explains the crime in the field of food safety on this basis.In addition,the current situation,characteristics and harmfulness of food safety crime are mainly studied.The second part briefly describes the current situation of relevant legislation in China,and then makes a statistical analysis of the judgments published on the Internet in the judgment documents,focusing on the analysis and study of the application status of article 408 of the criminal Law,so as to find out the problems existing in the legal provisions on crimes in the field of food safety in China.In the third part,some foreign laws and regulations related to food safety crimes are investigated,with the focus on understanding the criminal laws of countries such as the United States,Russia and Japan,and the status quo of China’s legislation are compared and analyzed,so as to obtain beneficial legislative inspiration.The fourth part,from the improvement of the criminal law system,the adjustment of penalty and execution link these three aspects of food safety crime legislation recommendations.
