The pre-sale permit system for commercial housing has always attracted attention because of its outstanding role and strong influence in the real estate industry.While increasing the speed of capital flow in the real estate industry,it has also reduced development costs such as loan interest rates for developers.Recommended and welcomed by real estate developers.However,because this system is greatly affected by many uncertain factors and is easy to be manipulated by individuals,it has become a safe haven for developers to be used by developers and cause losses to pre-purchasers in the actual performance of housing pre-purchase contracts,such as the delivery of developers Untimely,unqualified housing quality,and the appearance of "rotten building",so the appropriateness of the existence value of this system and its effect on the effectiveness and actual performance of the pre-sale of commercial housing are worthy of in-depth analysis and research.This article will discuss the relationship between the pre-sale permit certificate and the purchase contract effective through four chapters:First,select the more controversial cases,analyze and study from an empirical point of view,and analyze the problem,that is,the effect of the pre-sale permit of the commercial house on the effectiveness of the purchase contract.On this basis,try to evaluate the requirements for the purchase contract of the commercial house to take effect.Second,by combing the relevant laws and regulations of the certificate of pre-sale permits for housing in China,we will discuss the existing theoretical views of the effect of the certificate of pre-sale permits for commercial housing on the effectiveness of the contract,and make a system for the certificate of pre-sale permits based on relevant theories and opinions.Comment.Third,analyze and explore the shortcomings and factual problems of the commercial housing pre-sale permit system in light of the current development of my country’s real estate market.Fourth,on the basis of clarifying the relationship between the house pre-sale permit and the validity of the purchase contract,we put forward feasibility suggestions for my country’s future improvement and abolition of the commodity house pre-sale permit system. |
