Legal Research On The Consumer Rights Protection In Online Virtual Property Transaction

The continuous development of Internet technology has enabled the generation of network virtual property.While network virtual property has provided people with a richer experience,cases of infringement disputes in their transaction links also frequently occur.Because of the differences between the types of online virtual property and traditional property,and China has not yet established specific legal regulations for online virtual property,there are many problems in legal protection of consumers’ online virtual property transactions.To this end,this article analyzes the actual situation of consumer rights and interests in online virtual property transactions from the following aspects,and proposes specific suggestions for improvement:First,the introduction.Explain the research background,purpose and meaning of thesis writing,and explain the basic situation of thesis writing.Second,the basic theory of consumer rights protection in online virtual property transactions.This section starts from the perspective of the concept,characteristics,classification of network virtual property,and the necessity of legal protection in network virtual property transactions,and highlights the necessity and value of the thesis on the basis of explaining the essence of network virtual property.Third,the basic status of consumer rights protection in online virtual property transactions.This section uses real cases and legal perspectives to analyze the practical aspects and specific legal requirements to identify the shortcomings of legal protection in online virtual property transactions.After research,it is found that the shortcomings of current legal protection are: On the legislative level,it is reflected in two aspects: the legislative content is incomplete,and the supporting legal system of online virtual property transactions is incomplete;in the law enforcement level,it is reflected in two aspects: the law enforcement system is relatively vague and law enforcement standards have not yet been determined;in the judicial level,it is mainly reflected in evidence acquisition It is difficult and the evidence is not effective.At the consumer level,it is mainly reflected in the lack of protection consciousness in consumer virtual property transactions.Fourth,the protection of consumer rights and interests in online virtual property transactions can draw lessons from experience and inspiration.This section starts from the perspectives of consumer legal protection in online virtual property transactions in the United States,Japan,South Korea,Hong Kong and Taiwan of China,etc.,and draws relevant enlightenment from it.It provides a basis for subsequent suggestions for improvement.Fifth,improve suggestions on protecting consumer rights in online virtual property transactions.Combining with the previous research results,this section proposes specific experiences that can effectively improve the legal protection of consumer rights and interests in online virtual property transactions from three perspectives: legislative,law enforcement,and judicial.For example,at the legislative level,improve the laws and regulations related to the protection of consumers’ rights and interests in online virtual property,and improve the supporting legal regulations for online virtual property transactions;at the level of law enforcement,clearly define the network virtual property law enforcement system and establish uniform law enforcement standards;at the judicial level,reduce transactions Difficulty in obtaining evidence and establishing sound evidence preservation measures;at the consumer level,increase countermeasures such as increasing awareness of the protection of consumer rights and interests in consumer online virtual property transactions,and expanding the scope of propaganda for consumer rights protection in online virtual property transactions.
