| The issue of climate change has always been a hot issue in international research.As global warming has led to continued high sea levels in coastal areas,global sea level rise has accelerated.The cumulative effect of sea level rise will directly cause low-lying areas to be flooded with seawater,and at the same time bring catastrophic events such as flooding,seawater intrusion and coastal erosion to coastal countries.Some coastal nations and small island nations have already faced issues such as shrinking living areas,relocation of people inside and outside the country,and protection of human rights.Although the challenges brought about by sea level rise are no longer confined to a certain field of international law,they have become the intersection of issues in various fields of international law.This article studies the impact of sea level rise on the marine rights and interests of coastal countries from the perspective of islands.It mainly focuses on islands.The impact of sea level rise on the"legal status of islands","the delimitation of islands" and "artificial consolidation of" islands "From three perspectives,analyze the impact of rising sea levels.In addition to the introduction,this article is divided into four parts.The first part clarifies the current situation of sea level rise.From the analysis of the rate of sea level rise,the causes of sea level rise,and the consequences of sea level rise,it is found that the rate of global and regional sea level rise is increasing year by year;global warming caused by climate change and glaciers Melting is the main cause of rising sea levels;rising sea levels will not only submerge some of the land in low-lying coastal cities,but the impact on islands will also bring changes in marine rights and interests to coastal countries.The second part aims to clarify the importance of the island to the country through a specific analysis of the "legal status of the island," and to explore how the rise in sea level affects the legal status of the island.In this section,the legal status of islands is determined through three aspects: the definition of islands,the identification of islands and related concepts,and the provisions of the island system in the United Nations Law of the Sea.Finally,the analysis of sea level rise on islands is made by different levels of sea island coverage after sea level rise Impact of legal status.The third part focuses on "the role of demarcation of islands".It analyzes the importance of islands in delimitation from the principles of marine delimitation and the effectiveness of islands in marine delimitation.The impact is divided into the four sea areas such as the territorial sea that can be claimed by coastal states and the maritime delimitation of neighboring or opposite countries.The main influencing factors are the location of the island and the legal status of the island.The fourth part focuses on the legitimacy of the artificial "island" and the legal status of the object after artificial attachment.There are different standards for the legitimacy of artificial appendages for different submarine features,mainly due to the different rights of coastal countries to the sea area where the objects of artificial appendages are located,which makes the legal standards of artificial “islands” different.The legal status of the object after the addition does not change the role of the legal status of the object it relies on in the ocean.Finally,it is analyzed whether artificial “islands” are feasible in dealing with the threat of sea level rise. |
