Chinese islands located in the South China Sea have been facing the serious challenge.to be specific, in spite of both Chinese government and Chinese people's opposition, Vietnam, Philippine, Malaysia, Indonesia and Brunei have been invading some of islands since the mid 20th century, neglecting the fact that the people's of republic of china have only sovereignty to the South China Sea and affiliated islands. In order to gain profit, the Southeast countries such as Vietnams, Philippine have invaded some islands located in South China Sea that are supposed to belong to China. What's worse, in order to check and supervise china, the five countries spare no effort to draw America, Japan, Russia and ASEAN in the dispute. They level this issue international one, comfundo it, and put the pressure on china so that the dispute has been delayed unsolved. In view of vital interests bearing on peace and development, in order to stand for their settlement though friendly consultation, china adhere to the general designer of the reform and opening up-Deng Xiaoping's diplomatic tactics "sovereignty belongs to china, put aside disputes and go in for joint development" and have signed《in the south china sea zone of agreement tripartite joint agreement the seismic work》with Vietnam and Philippine. In fact, during a long period of time, "sovereignty belongs to china, put aside disputes and go in for joint development" have played an important role in the region. However, in the late 20th century, the five neighbor countries independently developed the islands, although the disputes are put aside. As a result, among so many oil wells in the South China Sea, there is no Chinese oil well. Furthermore, except Brunei, other four countries claim sovereignty over the South China Sea. Especially Vietnam, it claims that it have full sovereignty on the South China Sea, which can't be bore. Vietnam takes the trouble and collects some historical date as evidence to show it own the South China Sea, which are proved fiction.The fact above shows that it is a big change for china how to solve the territorial disputes in the current period of peace rise. This paper stresses Chinese stand on the issue, represent the historical standards and legal basis about Chinese sovereignty on the South China Sea. Then, the passage further reveals the origin of the disputes. Finally, the author tries to look into the ways to solve the disputes.Chapter 1:It begin with the intensification of the dispute in 2009, and retell china's only sovereign right to the South China Sea by quoting chinese foreign ministry of the note. Next, it denotes the origin of the dispute of the South China Sea in the historical and phase method.Chapter 2:By using graphical method and international political reality theory, it analyzes the cause of the five countries'occupation in the South China Sea.Chapter 3:From the sea itself and international law the point of view, it tells new features taken on in the dispute in the time by the international maritime conventions on the rule of law.Chapter 4:From the military point of view, it narrates the negative effects on the region's stability and political mutual trust between countries resulting from the South China Sea dispute.Chapter 5:Against Vietnam and Philippines's fictions, china prove them error and absurdity, as well as the two countries have their purposes-get benefits.Chapter 6:Comprehensively it points that on a new era china should introduce wise political wisdom great diplomatic skill and powerful military capacity to settle the dispute.Inclusion:It reconsider the chapters and the research process, and draw an inclusion on how to solve the South China Sea dispute in the current period of peace rise.
