Research On China’s Local Legislative Planning

Since the 1980s of last century,China’s local legislation has undergone a major transformation from provinces,municipalities,and larger cities to district-based cities.The rapid development of local legislation has played a positive role in promoting China’s rule of law.However,while making great achievements in local legislation,it has always faced various challenges.Traditionally,the contradiction between legislative capacity,legislative resources and legislative needs persists;in reality,regional economic integration and the transformation and upgrading of local economies have put forward new and higher requirements for local legislation.Therefore,in order to rationally allocate and effectively use local legislative resources,we should control from the source of legislative planning,through the initial "filtering" process,eliminate legislative proposals that do not meet the "minimum" standard,and then pass "prioritization" Process,looking for the "best" option for investing local legislative resources.In the course of operation,local legislative planning is centered on the legislative purpose.Both the formulation and revision activities are carried out simultaneously,the legislative plan is carried out around the legislative plan,and the number of legislative projects is on the decline.In practice,there are stagflation performances such as a single source of the project,low initiative of the government to establish the project,legislative topic deviating from the problem orientation,and insufficient demonstration of legislative projects.Based on this,on the one hand,the source of legislative projects should,on the one hand,play the role of the public or public representatives in local legislative planning by optimizing the allocation of human resources and improving the public opinion collection mechanism;on the other hand,it must also improve the administrative regulations The mechanism of the review mechanism for the filing of sex documents,to prevent the problem of low initiative of the government in some regions,and to play the role of the government in the local legislative planning,so that the local legislation is legitimate and reasonable at the source;in the demonstration of the project,The demonstration of legislative projects should be standardized and institutionalized.The content of argumentation of legislative projects should include the legitimacy,necessity,feasibility,effectiveness and coordination of the legislative application projects.The method of project argumentation can adopt online argumentation and hold legislative debates.The "good law" + "emergency" mode is adopted in the selection criteria of legislative proposals,and the selection method of legislative proposals should adopt the "department consultation + expert advice + determination by the National People’s Congress" It is necessary to break through the legislative planning model of the five-year system of the central government,change the period of legislative planning in accordance with its own actual situation,and reserve time for unexpected legislation.At the same time,we can learn from the practices of the national economic and social development planning during the implementation process,establish an effective accountability mechanism,and solve the problem of insufficient legislative planning.
