Research On The Legal Risk Prevention And Control Of Intellectual Property Rights Of Chinese Enterprises Listed In The US

The more mature securities industry in the United States has a strong appeal to Chinese enterprises.The listing of Chinese enterprises in the United States can not only further broaden their financing channels,but also enhance the brand effect at the international level and enhance the value status of enterprises.As a result,many Chinese enterprises have embarked on the path to go public in the United States.However,the rapid development of the capital market is accompanied by an increase in legal risks.Among the many types of legal risks,enterprises going public in the United States are the most lethal to the legal risks of intellectual property and are one of the significant factors for their successful listing.The intensified US-China trade frictions with intellectual property as the core will also likely affect the process of Chinese enterprises listing in the US.Some enterprises did not fully evaluate the legal risks of intellectual property rights,or were at a loss when they encountered disputes during the listing process,and some enterprises even suspended or stopped listing for these reasons.Therefore,based on this phenomenon,this article studies the prevention and control of intellectual property legal risks of Chinese enterprises listed in the United States.The first part of the article is "An Overview of the Intellectual Property Legal Risks of Chinese Companies Listed in the US".This section first introduces corporate legal risks,then it introduces the intellectual property legal risks of enterprises,including the concepts,characteristics and categories of intellectual property legal risks.Finally,it briefly analyzes the legal risks of intellectual property rights for listing in the United States,laying a foundation for the following.The second part of the article is "Overview of the Intellectual Property Legal Risks of Chinese Companies Going to the US".This section first introduces the types of intellectual property legal risks facing Chinese enterprises listed in the United States.Chinese enterprises listing in the United States face significant legal risks of pending intellectual property litigation,legal risks of illegal disclosure of intellectual property information,and legal risks of disclosure of trade secrets to the US Finally,through analysis of these legal risks,it is proposed that the reasons for these legal risks facing Chinese enterprises listed in the United States mainly lie in two aspects: first,the law itself causes adverse consequences;Second,the legal risk prevention and control mechanism lags behind.The third part of the article is "Problems Existing in the Prevention and Control ofIntellectual Property Legal Risks of Chinese Enterprises Listed in the United States".This part mainly analyzes the problems in the prevention and control of intellectual property legal risks of Chinese enterprises listed in the United States from an internal and external perspective.First,it is hindered by US intellectual property protection measures;second,it is lack of specialized intellectual property supervision of companies visiting the United States;the third is the lack of corporate intellectual property protection awareness;and fourth,weak internal management control of corporate intellectual property.The fourth part of the article is "Prevention and Control Strategies of Intellectual Property Legal Risks of Chinese Enterprises Listed in the United States." This part is mainly to comprehensively propose strategies and measures for the intellectual property legal risks and legal risk prevention and control of Chinese companies going to the United States for listing.
