Research On Policy Tools In The Protection Of Geographical Indication Products In Gui Zhou Province

Geographical indication,as an independent intellectual property system,is also a regional public brand management system,specifically for the protection of regional characteristics of the product name protection and quality protection.It is to point to some goods come from inside a certain area,the mark that the specific quality,prestige or other characteristic of this goods,basically by the natural factor of this area or human element place decides.Guizhou province is rich in resources of geographical indication products.By December 2019,the total number of geographical indication products in the province is 367,among which the original aqsiq has 138(ranking the fourth in China),98 geographical indication certification trademarks and 131 agricultural product geographical indicationGuizhou belongs to the less developed and underdeveloped areas,policy and guidance for the implementation of the geographical indication protection plays an important role,while the policy tool is to turn policy goals into the ways and means in reality,the tool rationality and scientific nature of the government’s policy on the protection of geographical indication products directly influence the utility,at the same time,the policy text is the key to research policy carrier,can spy on government problems when using policy tools.Therefore,this study will conduct quantitative research on policy tools based on the policy text.Firstly in this paper,the research train of thought,comb after reviewing the existing domestic and foreign related research,selected from 2009 to 2020 in guizhou province government promulgated the 37 protection of geographical indication products policy texts,and according to the theory of policy tools classification on the basis of the refined way and the choice of policy tools,will be the protection of geographical indication products needed policy tool is divided into Xu Qiu Xing,Gong Gei Xing type three types with the environment,the policy text publishing time,policy tools in using the preferences of different protection types,areas of policy tools category,function,activity,etc,to policy tools of analysis framework.After a brief qualitative analysis of the application status and effect of geographical indication protection policies in guizhou province,37 policy texts were selected and studied quantitatively based on statistical analysis and content analysis.On the basis of the analysis unit and the coding,on the basis of construct the analysis framework,grasp the general situation of the policy text in guizhou government protection of geographical indication products,development trend and analysis of the policy tool of different times and different types of protection policy tools use preference and policy tools in the field of type,function,activity in the process of the specific distribution,found that the use of policy instruments in a overall stability and consistency,and guizhou government prefer Gong Gei Xing when applying policy tools and the environment,policy tools in the field of industrial action and expansion process distribution is more.Through the policy text based policy tools of quantitative research,in-depth specific explores the guizhou government in the use of policy tools when problems in the protection of geographical indication products,mainly reflects in: policy tool type imbalances,policy tools toignore in intensive process play a role,the role of policy tools in the protection of geographical indication products such as uneven distribution of field.And from policy tool itself characteristic,tool use background,goal and path dependence analyze the reasons for problems occurred in guizhou province government USES policy tools,problem oriented,and combined with the foundation of guizhou province to protect geographical indication product demand,targeted put forward the optimized proportion of policy tools structure,promoting policy tools to the professional and intensive areas,in the intensive process of implementation of the policy objectives fit better policy tools such as Suggestions,in order to guizhou province in perfecting the existing government policy tools or introducing new tools to provide inspiration and new ideas,It can also provide reference for other regions to use policy tools to protect geographical indication products.
