In December 2018,the Mainland and Hong Kong and Macau respectively signed the<CEPA Agreement on Trade in Goods>.This agreement came into effect on the date of signing,and it was formally implemented on January 1,2019.This agreement comprehensively sorts out the contents of goods trade in CEPA and its supplementary agreements,and combines the development of economic and trade development between the Mainland and Hong Kong and Macao in the 15 years since CEPA was signed.It refers to the latest achievements of goods and trade agreements in international and regional economic cooperation,and provides cross-strait,three-place trade.The exchanges provided a more comprehensive institutional arrangement.Among them,the agreement focused on formulating rules of origin that are in line with international rules and the actual needs of Hong Kong and Macao in the form of special chapters,with a view to promoting exchanges and cooperation between the Mainland and Hong Kong and Macao trade and maintaining the stable development of Hong Kong and Macao industries.Taking this as an opportunity,this article analyzes the specific provisions of the rules of origin under the CEPA Agreement on Trade in Goods,combines the evolution of the rules of origin of CEPA goods over the years,and compares them with the rules of origin of free trade agreements in mainstream models of the international community.Put forward suggestions for perfecting the rules of origin of future CEPA goods.Specifically,this article is divided into five sections:The first part first introduces the basic issues of the origin of CEPA goods,including a brief explanation of the basic theory of the rules of origin of goods,a brief description of the legal nature and main functions of CEPA,and a detailed analysis of the historical development of the rules of origin of CEPA goods by using literature analysis.Comb and summarize the institutional characteristics of the rules of origin of CEPA goods.The second part mainly elaborates on the CEPA cargo origin rules,and analyzes and interprets the CEPA cargo entity rules from the three aspects of origin identification standards,accumulation rules and trace clauses,and compares them with the pan-European origin The corresponding contents of the rules,North American rules of origin and ASEAN rules of origin are compared in detail,and the degree of restriction of the physical rules of origin of CEPA goods is analyzed.The third part discusses the procedural rules of origin of CEPA goods in detail.It mainly analyzes and expounds the procedural rules of CEPA goods from three perspectives,such as direct transport rules,rules of origin declaration,and rules of origin management.The corresponding contents of the rules of origin,North American rules of origin and ASEAN rules of origin are compared in detail to reveal similarities and differences.The fourth part mainly puts forward suggestions for improving the rules of origin of CEPA goods,combining the pan-European rules of origin,North American rules of origin and ASEAN rules of origin,as well as the legislative system of domestic rules of origin and the relevant provisions of China’s signing of free trade agreements.Four suggestions were made to improve the criteria for appellation of origin,implement diagonal accumulation rules,innovate the form of declaration of origin,and introduce a system of origin determination,and analyze its feasibility from the perspective of legal principles and practice.The fifth part is the concluding part of this article.On the basis of summarizing the characteristics,content and recommendations of the CEPA goods origin rules,it is necessary to pay attention to perfecting the CEPA goods origin in combination with the legal nature of CEPA and the formulation purpose when proposing to improve and upgrade the rules of origin of goods in the future.
