In recent years, the trade of service has been developing in a very high speed,and gradually became an essential part of international trade. In international servicetrade, the rules of origin has great importance with regard to the adaption of the rulesof international sevice trade and the formulation of trade service regulation of acountry. A set of fair and reasonable rules of origin of international service trade hasmuch value for the development of international service trade and the study ofrelavent regulations.This essay will discuss the topic of how to identify the origin of service trade,and will be divided into three parts:In the first part there will be introductions of fundamental conceptions related tothe origin of service trade. By discribing and analysing the concepts such as “service”“service trade” and “origin”, the author tries to reveal that a set of reasonable and fairrules of service trade has massive effects on international economy. Meanwhile, inthis chapter, we will also talk about the specialty and fuctions of the rules of originrelated to trade service. Now WTO has set Agreement on Rules of Origin whichoriginated from Uruguay round to bound good service. But the uniqueness of servicetrade makes it impossible to use this set of rules or any other rules of origin related tothe service of good. The author will try to analyse the difference between service tradeand good trade based on the different characters of them, and will explain why servicetrade can not use the same origin rules as good service.In the second part we will analyse the regulations related to origin of servicetrade in GATS as well as some classic cases occured in WTO dispute resolution,inthe light that it will help developing the rules of origin related to service trade inChina. And the author will introduce the regulations related to the origin of tradeservice in CEPA, which was signed by China’s mainland, Hong Kong and Macau.And the author will summarize the trend and pattern in thern, and analyse theiradvantages as well as disadvantages. The last part will be displayed in the trail of the history of the development oflegal service in China. We will try to figure out the development level of our country’slegal service and how the origin of service trade affects legal service based on therelative regulations in CEPA and the promise China has made when it entered WTO.
