The preliminary verification mechanism is the product of China’s anti-corruption practice,and it is an anti-corruption weapon that has emerged and matured against the backdrop of the increasingly severe and complex anti-corruption struggle in China.Long-term practice has shown that the preliminary verification mechanism is of great significance for the protection of citizens’ legitimate rights and interests,the improvement of the efficiency of handling cases,and the efficient use of anti-corruption resources.However,for a long time,the preliminary verification has not been clearly stipulated by the law,and its legal status is also in an awkward position.This makes the preliminary verification mechanism divergent and restricted in both practice and theoretical circles.With the comprehensive implementation of the reform of the supervision system in China and the promulgation of the Supervision Law of the People’s Republic of China(hereinafter referred to as the Supervision Law),the preliminary verification procedures were clearly stipulated in Article 38 of the Supervision Law It was regulated in legal form and established its legal status.The incorporation of the preliminary verification procedures into legal regulations this time is a summary and sublimation of the valuable experience of China’s anti-corruption agencies over the years,and it also complies with the requirements of China’s basic strategy of governing the country in accordance with the law.The preliminary verification procedure of the supervisory authority is an independent investigation stage before the supervision of the case is filed.It is the first step for most post violations and official crime investigations to be entered into the case.It is of great significance for the effective implementation of the supervision work.The application in the process of organizing cases is also very extensive.However,the provisions on the preliminary verification procedures of the supervisory authority are only stipulated in Article 38 of the Supervision Law,and the content provisions are relatively crude.They only set up a basic framework for the preliminary verification procedures.It is difficult to provide effective guidance for preliminary nuclear work,and it cannot meet the actual needs of preliminary nuclear practice.Therefore,to conduct a more in-depth and systematic research on the preliminary verification mechanism of the supervisory authority,and to propose an effective solution to the practical dilemma encountered in the preliminary verification practice of thesupervisory authority,is of great significance for the establishment and improvement of the preliminary verification mechanism of the supervisory authority.This article is based on theory and practice.It sorts out and discusses the preliminary verification mechanism of China’s supervisory authorities,with a view to constructing a more comprehensive preliminary verification mechanism of supervisory authorities,so that they can play a greater role in anti-corruption practice.This article is mainly divided into four parts,discussing the preliminary verification mechanism of the supervisory authority.First of all,based on the related concepts of preliminary verification by the supervisory authority,a preliminary analysis of the emergence,development,concept,and characteristics of the preliminary verification of the supervisory authority was conducted,aiming to form a systematic understanding of the preliminary verification mechanism of the supervisory authority.Secondly,it explores the positive significance of the preliminary nuclear mechanism of the supervisory authority for anti-corruption and its operation process.Thirdly,it focuses on the investigation and research of the problems existing in the preliminary verification mechanism of the supervisory organs in practice,analyzes and explores the system defects and the status of operation,and at the same time explores the causes of them,and provides theoretical support for the orderly solution.Finally,in view of the actual dilemma of the preliminary verification system,a specific idea is proposed for the improvement of the preliminary verification system.
